AGENDA HEADING:

Approving and authorizing the execution of Iowa Department of Transportation (IDOT) Preconstruction Agreement for Keo Way (Birds Run) Phase 2 Storm Sewer Outlet.

SYNOPSIS:

Approval of the Preconstruction Agreement between the City of Des Moines and the Iowa Department of Transportation (IDOT) for the Keo Way (Birds Run) Phase 2 Storm Sewer Outlet and a small portion of 31^st Street (Ingersoll Run) Phase 1 Storm Sewer Outlet in association with I-235 reconstruction.  Approval of this agreement will allow construction of the project, estimated at $7,163,830.  The IDOT will bid the projects and perform contract administration, while the City of Des Moines will perform construction inspection, traffic control inspection, and construction administration services for this project.

Funding Source:  Various funding sources as noted below:

• $3,745,861 for storm sewer outlet and enhancements, 2006-07 CIP, Page Street-23, I-235 Storm and Sanitary Sewer Improvements, STR197
• $974,426 for sanitary sewer work, 2006-07 CIP, Page Sanitary-9, CSS-Birds Run Overflow Elimination Project, SAE118
• $2,443,543 for street and signal work, IDOT

ADDITIONAL INFORMATION:

The IDOT will initially pay all costs associated with this project, except for the sanitary sewer construction.  The project is included under the I‑235 Predesign Agreement between the City and IDOT (Agreement No. 2001‑P-028, dated October 9, 2000).  Under said agreement, the City shall repay the IDOT a percentage of storm sewer outlet costs based upon the percentage of drainage area for I-235 and the City.  The storm sewer enhanced capacity shall be 100% City cost.  This repayment will commence in FY 2007-08.  The City must pay 100% of the cost of the sanitary sewer reconstruction.

A preconstruction agreement for Keo Way (Birds Run) Outlet Storm Sewer and 31^st Street (Ingersoll Run) Storm Sewer Outlet projects has been negotiated with IDOT to identify the responsibilities of IDOT and the City regarding the administration, funding, and implementation of the project construction, as well as future maintenance responsibility of City facilities such as storm and sanitary sewers.  Construction will begin in the spring of 2006.
