AGENDA HEADING:

 

Authorization to proceed with acquisition of the necessary right-of-way and easements for the 2008 Storm Sewer Repair Project by gift, negotiation, or condemnation.

 

 

SYNOPSIS:

 

Authorization to acquire necessary right-of-way and easements for the above project.  This action is required by Iowa law before the City can initiate the right-of-way acquisition process under eminent domain. 

 

 

FISCAL IMPACT:

 

Amount:  $25,000 estimated for right-of-way acquisition.

 

Funding Source:  2007-08 CIP, City-wide Storm Water Utility Projects, STE057, Page - Storm Water Improvements 5.

 

 

ADDITIONAL INFORMATION: 

 

The 2008 Storm Sewer Repair Contract 1 includes the need for permanent easements for storm sewer located at 1505 Clinton Avenue, owned by Paul W. and Dianne G. Wright, and 1509 Clinton Avenue, owned by Margaret A. Lumley.  Additionally, a 25 x 300 foot strip lying east of and adjoining the east property line of property located at 1603 Euclid Avenue, where Garvis Honda Town is located, owned by Garco, Inc., George G. Garvis, President, will be acquired in fee title for the sewer project and to correct the street right-of-way along 16th Street.
