AGENDA HEADING:

 

Second reading of text amendments to the Zoning Ordinance and the Site Plan Ordinance to establish design guidelines for review of gas station and convenience store site development by the Plan and Zoning Commission.

 

 

SYNOPSIS:

 

On March 24, 2008, the City Council held a public hearing and approved the first reading of the ordinance.  The Council also received communication from Quik Trip requesting modifications to the proposed ordinance.  At their March 31, 2008 workshop, the City Council requested that the Plan and Zoning Commission review the proposed ordinance and communications from Quik Trip and Des Moines Neighbors for possible amendments.

 

The revised ordinance is attached to the roll call as Exhibit “A”.  Changes to the ordinance since the first reading include the following:

 

  • Amend the first paragraph of Section 82-214.8 to state the criteria in an affirmative or positive manner without changing regulatory intent.

  • Amend Section 82-214.8 [1][C]  to require open space of 20% of the site (existing requirement for all development) or 1,000 square feet per vehicle fueling location, whichever is greater.

    For a typical one acre site with 12 vehicle fueling locations (6 pumps), 12,000 square feet of open space would be required, which is 27.5% open space on the site.  For comparison, the Planned Business Park zoning district requires 35% open space.

 

  • Amend Section 82-214.8 [2][H] to clarify that the section is permissive and provides examples of treatments, but does not absolutely require all of the listed treatments to be incorporated in every design.

 

  • Amend Section 82-214.8 [2][I][i] to clarify that the integration of building and canopy materials should not be construed as a requirement to physically connect the building, canopy and site walls.

 

  • Amend Section 82-214.8 [2][I][ii] to increase the maximum allowable height of canopies from 17 feet to 18 feet.

 

  • Amend Section 82-214.8 [2][J] to accommodate display of seasonal items provided the areas are identified on the site plan, are located outside of required setbacks and should not exceed 5 feet in height.

 

  • Amend Section 82-214.8 [4][C] to allow accent lighting on the sides (fascias) of the canopy.

 

On April 17, 2008 the Plan and Zoning Commission voted 7-4 to recommend approval of the revised ordinance.

 

 

FISCAL IMPACT:

 

Amount:  Indeterminate.  Assessed values on new projects may increase due to a higher quality of design.

 

Funding Source:  General fund property tax revenue.

 

 

ADDITIONAL INFORMATION:

 

Quik Trip representatives discussed their requests for changes to the ordinance with the Regulation and Ordinance Subcommittee of the Plan and Zoning Commission on April 9, 2008.  The Committee also reviewed written communication from Des Moines Neighbors.  Quik Trip representatives were present at the April 17, 2008 Plan and Zoning Commission meeting and did not voice objection to the proposed ordinance revisions.  The P&Z letter attached to the roll call provides a summary of the discussion at the April 17, 2008 P&Z meeting.
