AGENDA HEADING:

Hearing on vacation and conveyance of the North/South alley right-of-way, between 22nd Street and 23rd Street from Olive Avenue to the Interstate 235 right-of-way, to adjoining property owners for $100.

SYNOPSIS:

Recommend approval of vacation and conveyance of the North/South alley right-of-way between 22^nd Street and 23^rd Street from Olive Avenue to the Interstate 235 right-of-way to adjoining property owners for $100. This action is required by Iowa law prior to making a final determination on the proposed sale by resolution. There is no current or anticipated public need for this property.

ADDITIONAL INFORMATION:

On April 21, 2008, by Roll Call No. 08-662, the City Council set the hearing on a request from Joseph Hill for vacation and conveyance of the north/south alley, between 22^nd Street and 23^rd Street from Olive Avenue to Interstate 235 right-of-way, to adjoining property owners for $100.

On May 21, 2007, by Roll Call No. 07-964, the City Council adopted a recommendation from the City Plan and Zoning Commission that the North/ South alley right-of-way, between 22nd Street and 23rd Street from Olive Avenue to the Interstate 235 right-of-way, be vacated and sold to the adjoining property owners, subject to reservation of an easement for all utilities now in place with the right-of-entry for servicing same.

The purchase of this property will allow assemblage of vacated right-of-way to the adjoining properties for the following owners, who have agreed to purchase their adjoining portions of the alley:

1. $50.00 – Joseph S. Hill and Sara J. Johnson
2. $50.00 – Michael W. Daniels, Jr. and Teleza M. Daniels

Moved by Vlassis to receive and file, and refer to the City Manager for implementation in accordance with the City’s standard property disposition procedures. Motion Carried 7-0.
