AGENDA HEADING:

 

Approving an Amendment to the agreement with Life and Fire Safety (LAFS).

 

 

SYNOPSIS:

 

Recommend approval of the transfer of the Life and Fire Safety (LAFS) vehicles from the City of Des Moines to the LAFS program. In 2001 the City acquired a Polk County grant to purchase a van and trailer for use by the LAFS program and the City holds the title to both vehicles. LAFS has used these vehicles exclusively since 2001 and the Chief of the Fire Department and the City Risk Manager desire to limit the City’s potential liability for use of the van and trailer by transferring the titles to these vehicle to the LAFS program.  The LAFS program has agreed to accept the titles of these vehicles.

ADDITIONAL INFORMATION: 

 

Life and Fire Safety (LAFS) is a 501(c)(3) organization that does public fire safety and other emergency related education, often in collaboration with the Des Moines Fire Department. The vehicles that LAFS have used exclusively are a 2001 Ford van (City inventory number 3160) with an estimated current value of nine thousand dollars ($9,000.00) having approximately thirty thousand miles and an enclosed trailer with an estimate current value of fifteen hundred dollars ($1,500.00); the total value of both vehicles thus being ten thousand-five hundred dollars ($10,500.00). These vehicles came into City ownership as the result of grant award from Polk County, the application for which was submitted by LAFS, and the intended use of these vehicles has always been exclusively for LAFS activities. The Chief of the Fire Department and Risk Manager desire to limit the City’s potential liability for use and maintenance of the van and trailer by transferring title of these vehicles to LAFS. The fair market value of the vehicles is approximately the value of the public education services provided to the citizens of Des Moines over the expected remaining useful life of the vehicles, so it is in the best interest of the City to transfer ownership of the vehicles to LAFS and to enter into an amendment to the Agreement to facilitate such transfer.

 

LAFS has agreed to accept title to the vehicles. Ownership of the vehicles will revert back to the city in the event of termination of LAFS or cessation for over six (6) months of the Life and Safety Program by LAFS. No city logos may be used on the vehicles during the period that LAFS assumes ownership.
