AGENDA HEADING:

 

Authorization to acquire the necessary right-of-way and easements for the SE 5th Street Sidewalk from East Miller Avenue to East Watrous Avenue Project by gift, negotiation or eminent domain.

 

 

SYNOPSIS:

 

Recommend authorization to acquire necessary right-of-way for the SE 5th Street Sidewalk from East Miller Avenue to East Watrous Avenue Project by gift, negotiation or eminent domain.  This action is required by Iowa law before the City can initiate the right-of-way acquisition process under eminent domain.  This project will require the acquisition of several small temporary construction easements and permanent utility easements from adjoining owners.  Relocation assistance will not be required for this project.

 

 

FISCAL IMPACT:

 

Amount:  $2,500 total estimated right-of-way acquisition and closing costs.

 

Funding Source:  2009-10 CIP, Page Sidewalk Improvements - 7, School Routes and Priority Sidewalks, STR081, G.O. Bonds with 50% of construction cost from CDBG funds, CDBG2008053, NDD Southpark Neighborhood Sidewalk.

 

 

ADDITIONAL INFORMATION:

 

This project includes the construction of Class ‘B’ Portland cement concrete sidewalk, four inches thick, six inches thick through driveways, together with appurtenances in accordance with contract documents on the west side of SE 5th Street from East Miller Avenue to East Watrous Avenue.  This project will enhance the safety of pedestrians.
