AGENDA
HEADING:
Authorization to acquire the necessary
right-of-way and easements for the 33rd Street Storm Sewer
Separation Project by gift, negotiation, or eminent domain.
SYNOPSIS:
Recommend
Council authorization to acquire necessary right-of-way for the 33rd
Street Storm Sewer Separation Project.
This project will provide for the separation of a combined sewer in the
Ingersoll Run Sewer service area that currently serves an area between 26th
Street and 35th Street from Ingersoll Avenue north to I-235 and
continuing northwesterly from I-235 to Kingman Boulevard and 38th
Street. This action is required by Iowa
law before the City can initiate the right-of-way acquisition process under
eminent domain.
FISCAL IMPACT:
Amount: Total estimated right-of-way acquisition
costs are not expected to exceed $25,000.

ADDITIONAL INFORMATION:
On
November 16, 2009, by Roll Call No. 09-2071, the City Council authorized the
Mayor to execute CDBG disaster recovery
infrastructure Notice of Award and Grant Contracts with the IDED. On
November 4, 2009, IDED notified the City of Des Moines that they had awarded
the City Community Development Block Grant Contract Number 08-DRI-234 in
the amount not to exceed $1,200,000 for the 33rd
Street Sewer Separation Project. Before IDED will send these Contracts for
execution by the City, IDED required the City to execute and return IDED’s
Notice of Award letter, whereby the City accepts the award described,
acknowledges that receipt of the Award is contingent upon satisfaction of all
conditions of the CDBG program and execution of the Contract and agrees to be
bound by the program and Contract requirements.
This
project provides for the separation of a combined sewer in the Ingersoll Run
Sewer service area that currently serves an area along the 33rd
Street corridor from High Street north to I-235 and continuing northwesterly
from I-235 to near Kingman Boulevard & 38th Street. New storm sewer would be constructed in areas
to accommodate the storm inlets currently connected to the combined sewer
system. New sanitary sewer would also be
constructed in areas to accommodate the sanitary sewer service connections
currently connected to the combined sewer.
This would allow the existing combined sewer in 33rd Street
to be removed from the existing combined Ingersoll Run Sewer and be connected
to the new Ingersoll Run Storm Sewer. This
will separate a portion of the sewer system in this area to help meet the nine
minimum requirements included in the current NPDES permit issued to the City of
Des Moines in December of 2001.
This
project will require the acquisition of several permanent and temporary
easements from adjoining property owners.
The easement acquisition process is expected to begin in late December
2009, after final design and easement plats are completed. Relocation assistance will not be required
for this project.
