AGENDA HEADING:

 

Approving 28E Agreement for the City of Des Moines Police Department to participate in the Central Iowa Traffic Safety Task Force (CITSTF) for specialized enforcement programs.

 

 

SYNOPSIS:

 

Recommend approval of the 28E Agreement for the Police Department to participate in the Central Iowa Traffic Safety Task Force for spcialized enforcement programs.  This agreement provides for collaborative joint targeted enforcement actions and the opportunity for improved public education and enforcement of traffic laws in Central Iowa.  Participating entities to date include:

 

·         Polk County Board of Supervisors for Polk County Sheriff’s Office

·         Dallas County Board of Supervisors for Dallas County Sheriff’s Office

·         City of Altoona

·         City of Ankeny

·         City of Clive

·         City of Johnston

·         City of Pleasant Hill

·         City of Polk City

·         City of Urbandale

·         City of Waukee

·         City of West Des Moines

·         City of Windsor Heights

 

Other agencies’ officers that participate are paid by their own Governor’s Traffic Safety Bureau (GTSB) grant funds received by their departments no matter what city they work on the CITSTF projects for.  For example, when Des Moines officers go to Ankeny to participate in a CITSTF project, the officers are paid overtime through Des Moines’ GTSB grant fund.

 

We currently participate in other cities’ CITSTF projects through a 28E agreement that allows Des Moines officers to write tickets in other jurisdictions.  By approving this 28E Agreement, Des Moines will be able to hold a CITSTF project in Des Moines, allowing outside agencies to come into our city and write our city ordinance tickets. 

 

 

FISCAL IMPACT:

 

Amount:  To be determined based on number of citations written by participating agencies in the City of Des Moines.

 

Funding Source:  Revenue will be deposited to Fines and Fees from Polk County, Account 457010, General Fund, GE001, FIN820700, Page 111, Fiscal Year 2011 Recommended Operating Budget.

 

 

ADDITIONAL INFORMATION:

 

The 28E Agreement will allow Des Moines to host Task Force activities and authorize participating agencies to work within the city limits of Des Moines and issue traffic citations under City of Des Moines municipal codes.  Outside participating agencies would utilize the citation forms of the City of Des Moines.  Regardless of employer, sworn peace officers of any participating member of this 28E Agreement are authorized to write tickets for the targeted enforcement.

 

Des Moines would host two Task Force projects annually.  These projects will be funded by overtime from the Governor’s Traffic Safety Bureau Grant.  The Des Moines Police Department would direct when and where an enforcement project would occur.  Fines generated from the targeted enforcement of city ordinances will go the City of Des Moines, regardless of the peace officer making the stop. This agreement is effective from the time of filing until June 30, 2012
