AN ORDINANCE to amend the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, and amended by Ordinance No. 12,040, passed September 20, 1993, and amended by Ordinance No. 12,063, passed November 8, 1993, and amended by Ordinance No. 13,453, passed April 21, 1997 by repealing paragraph (ii) of Section 2-362.03 thereof and enacting a new paragraph (11) of Section 2-362.03, all relating to the powers and responsibilities of the Airport Board.

Be It Ordained by the City Council of the City of Des Moines,

Iowa:

Section 1. That the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, and amended by Ordinance No. 12,040, passed September 20, 1993, and amended by Ordinance No. 12,063, passed November 8, 1993, and amended by Ordinance No. 13,453, passed April 21, 1997 be and is hereby amended by repealing paragraph (ii) of Section 2-362.03 thereof and enacting a new paragraph (11) of Section 2-362.03, all relating to the powers and responsibilities of the Airport Board, as follows:

2-362.03. POWERS AND RESPONSIBILITIES OF THE BOARD.

The board, except as otherwise herein provided, shall have the authority to govern the operation of the Des Moines International Airport, including but not limited to the following powers and responsibilities:

----------------------------------------------------------- (ii) Establish by regulation rates and charges for use of the airport, airport facilities, or airport services, to support the operations and development of the airport including passenger facility charges, except that admission charges and temporary parking charges for special events may be set by board resolution. The level of rates and charges shall be consistent with it's responsibility to maintain a positive cash balance in the Airport Enterprise Fund at all times.
