ORDINANCE NO. 13,536



AN ORDINANCE amending Ordinance No. 13,511, vacating portions of the Mattern Avenue and East 19th Street rights-of-way in the vicinity of their intersection.

WHEREAS, by Ordinance No. 13,511 passed July 28, 1997, after published notice and public hearing as required by law, the City of Des Moines vacated the portions of the Mattern Avenue and East 19th Street rights-of-way in the vicinity of their intersection more specifically described below; and,

WHEREAS, the Polk County Auditor has requested that the right-of-way description used in Ordinance No. 13,511, be amended to identify the names of the adjoining plats in compliance with Iowa Code §335.9; NOW, THEREFORE,

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa, as follows:

Section 1. The text of Section 1, of Ordinance No. 13,511 passed July 28, 1997, is hereby amended to be as follows:

The following described portions of the Mattern Avenue and East 19th Street rights-of-way in the vicinity of their intersection, be and are hereby vacated:

All that part of East 19th Street right-of-way lying East of and adjoining Lots 1 through 12, Block 13, T.E. Brown's Official Plat of the Northeast 1/4 of Section 36, Township 79 North, Range 24 West of the 5th P.M., Except the Northeast 40 Acres of the same and all that part of Mattern Avenue right-of-way (also known as Lot Z), of said T.E. Brown's, lying North of and adjoining Lots 12 and 13, Block 13, of said T.E. Brown's, and that part of Mattern Avenue right-of-way (also known as Cloverlawn Avenue) lying South of and adjoining Lots 24 and 25, Block 4, East End Addition, an Official Plat, and all that part of Mattern Avenue right-of-way (also known as said Lot Z and Cloverlawn Avenue), lying North of and adjoining and lying West of the northerly extension of the East right-of-way line of East 19th Street, all now included in and forming a part of the City of Des Moines, Polk County, Iowa.

Sec. 2. The City Clerk is hereby authorized and directed to cause a certified copy of this ordinance to be properly filed in the office of the Recorder of Polk County, Iowa.

Sec. 3. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
