ORDINANCE NO. 13,550

AN ORDINANCE vacating a portion of Urbandale Avenue extending north from Leado Avenue.


WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and

WHEREAS, it is desirable that the public right-of-way herein described be vacated; NOW, THEREFORE,

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the following described portion of the unimproved Urbandale Avenue right-of-way north of Leado Avenue be and is hereby vacated:

Commencing at the intersection of the North right-of-way line of Leado Avenue as it is presently established and the easterly right-of-way line of the Des Moines and Central Iowa Railway as it is presently established; Thence, South 89 (Degrees) 59' (Minutes) 16" (Seconds) West (assumed for the purpose of this description) along the westerly extension of the North right-of-way line of said Leado Avenue, a distance of 40.00 feet to the Point of Beginning; Thence continuing South 8959'16" West along the extension of the North right-of-way line of said Leado Avenue, a distance of 115.37 feet to the westerly right-of-way line of said Des Moines and Central Iowa Railway; Thence, northeasterly along the westerly right-of-way line of said Des Moines and Central Iowa Railway and along a 1136.22 feet radius curve concave northwesterly, a distance of 363.45 feet, said curve having a chord bearing of North 4341'52" East and a chord length of 361.90 feet; Thence, South 5527'57" East, a distance of 35.58 feet to a point that is 8.50 feet northwesterly of the centerline of the Beaverdale Recreational Trail as it is presently established; Thence southwesterly along a line 8.50 feet northwesterly of and normally distant from said centerline and along a 91.53 feet radius curve concave northwesterly, a distance of 14.18 feet, said curve having a chord bearing of South 4911'03" West and a chord length of 14.16 feet; Thence, South 5337'17" West along a line parallel with and 8.50 feet northwesterly of said centerline, a distance of 35.54 feet; Thence southwesterly along a line 8.50 feet northwesterly of and normally distant from said centerline and along a 108.52 feet radius curve concave southeasterly, a distance of 42.00 feet, said curve having a chord bearing of South 4232'02" West and a chord length of 41.74 feet; Thence, South 3126'46" West along a line parallel with and 8.50 feet northwesterly of said centerline, a distance of 67.78 feet; Thence southwesterly along a line 8.50 feet northwesterly of and normally distant from said centerline and along a 191.59 feet radius curve concave northwesterly, a distance of 29.30 feet, said curve having a chord bearing of South 3549'40" West and a chord length of 29.27 feet; Thence, South 4947'30" East a distance of 8.50 feet to said centerline; Thence continuing South 4947'30" East, a distance of 15.00 feet; Thence South 3629'27" West, a distance of 104.02 feet to the Point of Beginning, all now included in and forming a part of the City of Des Moines, Polk County, Iowa.

Sec. 2. That this vacation is made with reservations of right-of-way easements for any public utilities now in place with the right of entry for servicing same.

Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa.

Sec. 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
