ORDINANCE NO. 13,739
AN ORDINANCE to amend the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, by repealing Section 15-6 thereof and enacting a new Section 15-6, relating to sale of rights of interment in city cemeteries.
Be It Ordained by the City Council of the City of Des Moines, Iowa:
Section 1. That the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, is hereby amended by repealing Section 15-6 thereof and enacting a new Section 15-6, relating to sale of rights of interment in city cemeteries, as follows:
15-6. SALE OF BURIAL SPACES, LOTS AND PLOTS FOR RIGHT OF INTERMENT.
The city park and recreation department on behalf of the city of Des Moines is authorized to sell to persons or entities desiring to purchase interment space for purposes of interment in the city owned cemeteries the right of interment, subject to all restrictions of record and to all rules and regulations of the park and recreation department. The amount of fees for such right is to be recommended by the city park and recreation board for approval by the city council by ordinance. Fees for the right of interment must be paid at the time of arrangement for interment regardless of any prior agreement as to method of payment. The park and recreation director of the city is authorized to execute all right of interment documents.
Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
