ORDINANCE NO. 13,747
AN ORDINANCE to amend the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, as heretofore amended, by repealing subparagraph (i) of paragraph (2) of subsection (C) of Section 2A-13 thereof, and enacting a new subparagraph (i) of paragraph (2) of subsection (C) of Section 2A-13, regarding the permitted location of accessory buildings in the "R-5" Mobile Home Residential District.
BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:
Section 1. That the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, as restated by the Ninth Supplement thereto adopted June 16, 1997, by Resolution and Roll Call No. 97-2094, and further amended by Ordinance No. 13,124 passed December 5, 1994, be and is hereby amended by repealing subparagraph (i) of paragraph (2) of subsection (C) of Section 2A-13 thereof, and enacting a new subparagraph (i) of paragraph (2) of subsection (C) of Section 2A-13, regarding the permitted location of accessory buildings in the "R-5" Mobile Home Residential District, as follows:
2A-13. "R-5" DISTRICT REGULATIONS. (MOBILE HOME RESIDENTIAL DISTRICTS).
Statement of Intent. The "R-5" District is intended and designed to provide for certain medium density residential areas of the City now developed with mobile home parks, which by reason of their design and location are compatible with surrounding residential areas and areas where similar development seems likely to occur.

(C)Bulk Regulations. The following minimum requirements shall be observed, subject to the modifications contained in Sec. 2A-26.

(2)For any mobile home park:

(i)Garages and structures used for occupant storage facilities and located on mobile home spaces shall be not more than 17 feet and 1 story in height, and shall observe the following minimum setbacks:
Front yard setback: 17 feet from the edge of the closest park street.
Rear yard setback: 2 feet from the rear space line.
Side yard setback: 2 feet from the side space line. However, unless the accessory building is located such that at least one-half of its depth is to the rear of the mobile home, the accessory building shall also observe a 15' separation from any structure on an adjoining mobile home space.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided
by law.
