AN ORDINANCE to amend the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, and amended by Ordinance No. 12,040, passed September 20, 1993, and amended by Ordinance No. 12,063, passed November 8, 1993, and amended by Ordinance No. 13,453, passed April 21, 1997, and amended by Ordinance No. 13,517, passed August 18, 1997, by repealing subsection (xiv) of Section 2-362.03 thereof and enacting a new subsection (xiv) of Section 2-362.03, relating to power and responsibilities of the Airport Board.
Be It Ordained by the City Council of the City of Des Moines, Iowa:
Section 1. That the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991,
and amended by Ordinance No. 12,040, passed September 20, 1993, and amended by Ordinance No. 12,063, passed November
8, 1993, and amended by Ordinance No. 13,453, passed April 21, 1997, and amended by Ordinance No. 13,517, passed
August 18, 1997, is hereby amended by repealing subsection (xiv) of Section 2-362.03 thereof and enacting a new
subsection (xiv) of Section 2-362.03, relating to power and responsibilities of the Airport Board, as follows:
2-362.03. POWERS AND RESPONSIBILITIES OF THE BOARD.
The board, except as otherwise herein provided, shall have the authority to govern the operation of the Des Moines International Airport, including but not limited to the following powers and responsibilities:

(xiv)Acquire by voluntary sale or gift property interests as necessary to implement the Airport Noise and Land Use Compatibility Plan or other plan approved by the board. The board shall establish the fair market value on all property interests to be acquired by the Airport, except that it may delegate to the Aviation Director the establishment of fair market value on property acquisitions of $2,500 or less in value. All such acquisitions shall be accepted and approved by the city council.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
