ORDINANCE NO. 13,774
AN ORDINANCE vacating the alleys west of Pennsylvania Avenue between E. Grand Avenue and Des Moines Street.
WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and
WHEREAS, it is desirable that the public right-of-way herein described be vacated; NOW, THEREFORE,
BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:
Section 1. That the alleys west of Pennsylvania Avenue between E. Grand Avenue and Des Moines Street, more specifically described as follows, are hereby vacated:
Part of Lot 2, Block K, Griffiths Addition No. 2 to East Fort Des Moines, an Official Plat, all now included in and forming a part of the City of Des Moines, Polk County, Iowa, more specifically described as follows:
Beginning at the Northwest corner of said Lot 2; thence northeasterly along the North line of said Lot 2 a distance of 18.58 feet; thence southerly 80.00 feet; thence southeasterly 73.15 feet to a point on the South line of said Lot 2 being 79.4 feet westerly of the Southeast corner of Lot 1 of said Block K, also being the North line of the East/West alley right-of-way line; thence southwesterly along the South line of said Lot 2 a distance of 24.0 feet; thence northerly along the West line of said Lot 2 a distance of 154.32 feet to the Point of Beginning;
AND, all that part of the 18.0 foot East/West alley right-of-way lying South of and adjoining Lot 1, except the West 60.0 feet thereof, all in Block 20, East Fort Des Moines, an Official Plat; and lying South of and adjoining Lot 3 and lying South of and adjoining the westerly 24.0 feet of Lot 2, all in Block K, Griffins Addition No. 2 to East Fort Des Moines, an Official Plat, all now included in and forming a part of the City of Des Moines, Polk County, Iowa.
Sec. 2. That this vacation is made for a public purpose and all utilities with facilities within the vacated right-of-way described above are hereby ordered to promptly remove such facilities from such right-of-way.
Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa.
Sec. 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
