ORDINANCE NO. 13,802

AN ORDINANCE to amend the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, as heretofore amended, by repealing subsection (E) of Section 2A-17.01 thereof, and enacting a new subsection (E) of Section 2A-17.01, to remove the requirement for off-street parking for residential and neighborhood retail commercial uses in the "C-3A" District.

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, as restated by the Ninth Supplement thereto adopted June 16, 1997, by Resolution and Roll Call No. 97-2094, be and is hereby amended by repealing subsection (E) of Section 2A-17.01 thereof, and enacting a new subsection (E) of Section 2A-17.01, to remove the requirement for off-street parking for residential and neighborhood retail commercial uses in the "C-3A" District, as follows:

2A-17.01 "C-3A" DISTRICT REGULATIONS. (CENTRAL BUSINESS DISTRICT SUPPORT COMMERCIAL DISTRICTS).

Statement of Intent. The "C-3A" District is intended to provide for medium to high intensity pedestrian and auto oriented office, retail, commercial, mixed-use (commercial/ residential) development in support of the downtown core and would also serve the entire metropolitan area. It is intended this District not be mapped outside the downtown area.

(E)Off-Street Loading and Parking. Spaces for off-street loading and parking shall be provided in accordance with the provisions of Sec. 2A-24 and 2A-25, except: no off-street loading or parking shall be required for the following uses:

(1)Residential uses.

(2)Retail business and service establishments permitted in the "C-1" Neighborhood Retail Commercial District.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
