ORDINANCE NO. 13,807
An Ordinance temporarily refunding building, electrical, mechanical and plumbing permit fees for emergency repair work funded in part with grants from the Federal Home Loan Bank Affordable Housing Program.
WHEREAS, both Bankers Trust and West Bank have sponsored applications by the City of Des Moines seeking grants from the Federal Home Loan Bank Affordable Housing Program to assist low-income homeowners in the City with emergency repairs on their homes to permit them to remain in their homes; and,
WHEREAS, the Chesterfield and Laurel Hill Neighborhoods have applied for grants from the Federal Home Loan Bank Affordable Housing Program to assist low-income homeowners in the Chesterfield and Laurel Hill Neighborhoods with emergency repairs on their homes to permit them to remain in their homes; and,
WHEREAS, the City Council desires to provide for the refund of building, electrical, mechanical and plumbing permit fees paid for emergency repair work to owner-occupied dwelling undertaken under the Federal Home Loan Bank Affordable Housing Program;
NOW THEREFORE, BE IT ORDAINED, by the City Council of the City of Des Moines, Iowa:
SECTION 1. REFUND OF FEES. A. All fees imposed by the following sections of the Municipal Code of the City of Des Moines, and paid for emergency home repairs undertaken pursuant to the Federal Home Loan Bank Affordable Housing Program shall be subject to refund:
§ 8-12 Building Permit fees
§ 8-103 Electrical Permit fees
§ 8-147 Mechanical Permit fees
§ 8-190 Plumbing Permit fees
B. The refund shall apply only for permits issued after April 1, 2000, and prior to December 31, 2001, provided further that the conditions for refund of the fee shall have been satisfied prior to June 1, 2002.
C. The refund shall be paid by the Community Development Department upon certification by the Community Development Director or his designee that all the work authorized by any such permits has received final City inspection and approval, and that the work was for emergency repairs to an owner-occupied dwelling undertaken pursuant to the Federal Home Loan Bank Affordable Housing Programs identified above.
Sec. 2. Effective Date/Duration. This Ordinance shall be in full force and effect from and after its passage and publication as provided by law. This Ordinance and the refund of permit fees hereby authorized shall lapse and be of no further force or effect after July 1, 2002.
