ORDINANCE NO. 13,817

 

AN ORDINANCE to amend the Municipal Code of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, and amended by Ordinance No. 11,870, passed August 17, 1992, and amended by Ordinance No. 13,010, passed March 28, 1994, by repealing Section 8-147 thereof and enacting a new Section 8-147, relating to permit fees for building construction.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, 1991, adopted by Ordinance No. 11,651, passed April 15, 1991, and amended by Ordinance No. 11,870, passed August 17, 1992, and amended by Ordinance No. 13,010, passed March 28, 1994, is hereby amended by repealing Section 8-147 thereof and enacting a new Section 8-147, relating to permit fees for building construction, as follows:

8-147. PERMIT FEES.

(a) Schedule. There shall be paid to the office of the building official for the issuance of each mechanical permit the sum of $7.50 plus the following unit fees:

(1) For the installation or relocation of each forced air or gravity-type furnace or burner,each floor furnace, each suspended heater,recessed wall heater, floor mounted unit heater or other heat producing appliance,including air ducts attached to such appliances-------------------------------------$10.50 plus $4.50 per

(2) For the installation, relocation, or replacement of each appliance vent or chimney------------------------------------------------$9.00

 

(3) For the repair of, alteration of, or addition to each heating appliance,refrigeration unit, comfort cooling unit, absorption unit, or each comfort heating, cooling, absorption, or evaporating cooling system, including installation of controls regulated by this code---------------$ 7.50

 

(4) For the installation or relocation of each boiler-------------$9.00 plus $3.00 per

(5) For the installation or relocation of each comfort cooling system or refrigeration unit-------------------------------------------------$9.00 plus $3.00 per 100,000 BTU/H or fraction thereof

 

(6) For each air handling unit, including ducts------------------$6.00

 

(7) For each single duct ventilation fan---------------------------$4.50

 

(8) For each evaporative cooler (non-portable), hood (including ducts), or separative ventilation system-----------------------------------$7.50

 

(9) Gas piping: First four outlets---------------------------------$3.00 each

All outlets over four----------------------------$1.50 each

 

(10) For each appliance or piece of equipment regulated by this code but not classed in other appliance categories, or for which no other fee is listed in this code---------------------------------------------------------------$7.50

 

For each fuel burning fireplace, stove, or similar

appliance-(See (2) above for chimney fee)-----------------$15.00

 

Fire or Fire/Smoke Dampers

First damper-----------------------------------------------------$10.00

All additional dampers----------------------------------------$ 1.00 each

(b) Double fee. Except in emergency situations, as determined by the senior mechanical inspector, where work for which a mechanical permit is required by this code is started or proceeded with by any person prior to obtaining a required permit, the regular fees as specified in this code for such work shall be doubled, provided such increase shall not exceed $200.00. The payment of such double fee shall not relieve any persons from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein and, no additional permits shall be issued to any person who owes the city the double fee described in this section. However, no double fee shall be imposed upon any person who starts work without a permit if:

(1) The work is started on a Saturday, Sunday, or holiday, or during any other day when the department of building is not normally open for business; and

(2) The person secures the proper permit on the next working day of the office of the building official.

(c) Fee exemption. Persons performing mechanical work for the federal government or the state of Iowa or any political subdivision of the state of Iowa may obtain permits for such work without paying the permit fees described herein; provided that nothing in this section shall be construed to exempt payment of permit fees by persons who commence such mechanical work prior to having obtained a permit therefor or by persons performing work under the direction of the city of Des Moines in connection with the abatement of any public nuisance on private property, pursuant to city ordinance or state law.

(d) Additional payment. In the event that a mechanical permit is issued for a specific amount of work and upon inspection, it is determined that more work was performed than was authorized on such permit, the permittee shall obtain another permit to include all such additional work and shall pay only $1.00 plus the unit fees prescribed in subsection (a) of this section.

(e) Collection of fees. All fees due the city for examinations, licenses, and permits shall be collected in the office of building official and paid thereafter to the city treasurer.

Refunds. If, within 60 days of the date of issuance, the holder of a mechanical permit decides not to commence the work described in said permit, he or she may, upon application to the building official, be refunded that portion of the permit fee which is in excess of $10.00. The refund of any fee of $10.00 or less shall not be made.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
