ORDINANCE NO. 13,820

AN ORDINANCE to amend the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 2A-5 of the Municipal Code of the City of Des Moines, 1991, by rezoning and changing the district classification of certain property located in the vicinity of 5211 S.E. 14th Street from the "R1-80" One Family Residential District and "PUD" Planned Unit Development District classifications to a "PUD" Planned Unit Development District classification.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 2A-5 of the Municipal Code of the City of Des Moines, Iowa, 1991, be and the same is hereby amended by rezoning and changing the district classification of certain property located in the vicinity of 5211 S.E. 14th Street, more fully described as follows:

Lots 1, 2, 3, 4, 5, and the West 1304.83 feet of Outlot Y, Southeast Market Center Plat 1, an Official Plat, all now included in and forming a part of the City of Des Moines, Polk County, Iowa; and,

The North 341.29 feet of the South 361.29 feet of the West 10.0 acres of Lot 2 of the Official Plat of the Northwest 1/4 of Section 26, Township 78 North, Range 24 West of the 5th P.M., all now included in and forming a part of the City of Des Moines, Polk County, Iowa being more particularly described as follows:

Beginning at the Northeast corner of Lot 2, of said Southeast Market Center Plat 1; thence South 89o (Degrees) 20’ (Minutes) 08" (Seconds) East a distance of 363.75 feet to a point on the East line of the West 10.0 acres of Lot 2 in said Official Plat of the Northwest 1/4 of Section 26; thence South 00o24’18" West along the East line of the West 10.0 acres of said Lot 2 a distance of 341.29 feet; thence South 89o19’56" West along the northerly line of Lot 1, in said Southeast Market Center Plat 1 a distance of 361.22 feet to a point on the East line of said Lot 2, of said Southeast Market Center Plat 1; thence North 00o01’13" East along the East line of said Lot 2 a distance of 341.29 feet to the point of beginning. Said tract of land contains 31.95 acres more or less.

from the "R1-80" One Family Residential District and "PUD" Planned Unit Development District to a "PUD" Planned Unit Development District classification.

Sec. 2. This ordinance shall be in full force and effect from and after the later of its passage and publication as provided by law.

Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof to be properly filed in the office of the Recorder of Polk County, Iowa.
