ORDINANCE NO. 13,851

AN ORDINANCE vacating a portion of the S.E. 5th Street right-of-way extending south from Indianola Avenue.

WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and

WHEREAS, it is desirable that the public right-of-way herein described be vacated; NOW, THEREFORE,

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the portion of S.E. 5th Street right-of-way extending south from Indianola Avenue, more specifically described as follows, be and is hereby vacated:

Beginning at the Southeast corner of Lot 111, Crawford Place, an Official Plat; thence North 00o (degrees) 02’ (minutes) 59" seconds West, along the East line of said Lot 111, a distance of 31.00 feet; thence North 31o00'17" West, along the easterly line of said Lot 111, a distance of 33.75 feet; thence North 71o53'08" East, a distance of 51.18 feet to a point on a curve on the southerly right-of-way of Indianola Avenue as it now exists; thence along a curve on said southerly right-of-way to the left having a radius of 1,035.50 feet a delta of 01o03'20", an arc length 19.08 feet and a chord which bears South 48o18'00", East having a chord distance of 19.08 feet; thence South 40o37'14" West, a distance of 21.88 feet to a point on the East right-of-way line of Southeast Fifth Street; thence South 00o04'51" East, along said East right-of-way, a distance of 46.69 feet; thence North 89o44'13" West, a distance of 31.29 feet to the POINT OF BEGINNING, and containing 2,724 square feet more or less.

 

Sec. 2. That this vacation is made with reservations of right-of-way easements for any public utilities now in place with the right of entry for servicing same.

Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa.

Sec. 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
