ORDINANCE NO. 13,856

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by repealing subsection (14) of Section 134-552, subsection (8) of Section 134-845, subsection (9) of Section 134-949 and subsection (4) of Section 134-1159 thereof, and enacting a new subsection (14) to Section 134-552, to delete the floor area ratio limitations on development under the Zoning Ordinance.

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended, by repealing subsection (14) of Section 134-552, subsection (8) of Section 134-845, subsection (9) of Section 134-949 and subsection (4) of Section 134-1159 thereof, and enacting a new subsection (14) to Section 134-552, to delete the floor area ratio limitations on development under the Zoning Ordinance, as follows:

Sec. 134-552. Principal permitted uses.

Only the following uses of structures or land listed shall be permitted in the R-3 multiple-family residential district:

(14) Assisted living residential facility, provided the individual dwelling unit's total floor area shall not exceed a maximum of 70 percent of the building total floor area.

Sec. 134-845. Bulk regulations.

In the C-1 neighborhood retail commercial district, the following minimum or maximum requirements, as indicated, shall be observed, subject to the modifications contained in section 134-1296:

Sec. 134-949. Bulk regulations.

In the C-2 general retail and highway-oriented commercial district, the following minimum or maximum requirements, as indicated, shall be observed, subject to the modifications contained in section 134-1296:

In the M-3 limited industrial district, the following minimum or maximum requirements, as indicated, shall be observed, subject to the modifications contained in section 134-1296:

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
