ORDINANCE NO. 13,876
AN ORDINANCE vacating the North/South and East/West alley right-of-ways located between E. 21st Street and Ure Street and between E. University Avenue and South of Interstate 235 right-of-way
WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and
WHEREAS, it is desirable that the public right-of-way herein described be vacated; NOW, THEREFORE,
BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:
Section 1. That the following described North/South and East/West alley right-of-ways located between E. 21st Street and Ure Street and between E. University Avenue and South of Interstate 235 right-of-way, be and are hereby vacated:
All that part of 13.0 foot East/West alley right-of-way lying North of and adjoining Lots 14, 15 and 16, Haskell's Addition, an Official Plat, and lying North of and adjoining Lots 46, 47 and 48, Glenwood Place, an Official Plat, and lying North of and adjoining the vacated North/South alley right-of-way lying West of and adjoining said Lot 48; and, all that part of 12.0 foot North/South alley right-of-way lying West of and adjoining Lots 33 through 45, of said Glenwood Place, and lying West of and adjoining Lots 65 and 66, Ballard's Addition, an Official Plat, and the portion of said North/South alley lying West of and adjoining Lot 67 of said Ballard's Addition being southeasterly of a line beginning at a point on the West line of said Lot 67 being 32.0 feet North of the Southwest corner of Lot 67 and extending to a point on the East line of Lot 62 of said Ballard's Addition being15.0 feet North of the Southeast corner of said Lot 62, all now included in and forming a part of the City of Des Moines, Polk County, Iowa.
Sec. 2. That this vacation is made with reservations of right-of-way easements for any public utilities now in place with the right of entry for servicing same.
Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa.
Sec. 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
