ORDINANCE NO. 13,879

AN ORDINANCE to amend the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, by rezoning and changing the district classification of certain property located in the vicinity of 4301 Park Avenue from an "C-1" Neighborhood Retail Commercial District to a Limited "R-3" Multiple Family Residential District classification.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, be and the same is hereby amended by rezoning and changing the district classification of certain property located in the vicinity of 4301 Park Avenue, more fully described as follows, from an "C-1" Neighborhood Retail Commercial District to a Limited "R-3" Multiple Family Residential District classification:

A parcel of land in the Southeast ¼ of the Southeast ¼ of Section 13, Township 78 North, Range 25 West of the 5th P.M. within the City of Des Moines, Polk County, Iowa, more particularly described as follows:

Commencing at the Southeast corner of said Section 13, Township 78 North, Range 25 West of the 5th P.M., proceeding North 0o (Degrees) 06’ (Minutes) 53" (Seconds) West, 40.0 feet to a point on the North right-of-way line of Park Avenue; thence South 89o58’59" West, 100.0 feet parallel to the South line of the Southeast ¼ of said Section 13, Township 78 North, Range 25 West of the 5th P.M. to the point of beginning; thence North 0o06’53" West, 738.16 feet parallel to the East line of the Southeast ¼ of said Section 13 to a point on the South line of 100.0 foot vacated Chicago and Great Western railroad right-of-way; thence South 55o08’29" West, 648.58 feet along the South line of said 100.0 foot vacated Chicago and Great Western railroad right-of-way; thence South 26o51’47" East, 412.03 feet to a point on the North right-of-way line of Park Avenue; thence North 89o58’59" East, 347.5 feet along the North right-of-way line of Park Avenue to the Point of Beginning, containing 5.9819 acres.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.

Sec. 4. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof to be properly filed in the office of the Recorder of Polk County, Iowa.
