ORDINANCE NO. 13,984

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by repealing Sections 114-471 and 114-471.1 thereof and enacting new Sections 114-471 and 114-471.1, relating to city truck routes and penalty for violation of city truck routes.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended by repealing Sections 114-471 and 114-471.1 thereof and enacting new Sections 114-471 and 114-471, relating to city truck routes and penalty for violation of city truck routes, as follows:

Sec. 114-471. City truck routes.

(a) Every commercial vehicle which has a gross weight of up to but not exceeding 12,000 pounds, loaded or unloaded, shall have free and unrestricted use of all paved city streets.

(b) Every commercial vehicle which has a gross weight in excess of 12,000 pounds, loaded or unloaded, shall not be operated at any time upon any of the city streets or parts of streets except the streets which are specifically designated for their use in division 8 of article XVI of this chapter, except that such vehicles may be operated on any paved street or parts of streets for the purpose of delivering or picking up materials or merchandise and then only by entering such street at the intersection nearest the destination of the vehicle and proceeding thereon no farther than the nearest intersection thereafter. Those streets or parts of streets designated in division 8 of article XVI of this chapter are established as truck routes, on which a vehicle having a gross weight in excess of 12,000 pounds will have free and unrestricted use.

(c) Nothing in this article shall be construed to prohibit the Des Moines Metropolitan Transit Authority from operating their passenger buses upon any streets or parts of streets within the city which are or shall be designated as bus routes.

(d) For the purpose of this article, street identification signs posted on a blue background designate official truck routes. Street identification signs posted on a green background designate streets prohibited to commercial vehicles over 12,000 pounds except as allowed in subsection (b) of this section.

(e) No person shall permit a commercial vehicle owned or controlled by him or her to be operated directly or through an agent, employee or other person on city streets except as otherwise allowed in this section.

Sec. 114-471.1. Penalties for violation of truck routes.

(a) Any person who violates section 114-471(b) of this article shall be fined in the amount of $100.00 (one hundred dollars).

(b) Any person who violates section 114-471(e) of this article shall be guilty of a municipal infraction punishable by a civil penalty as provided by section 1-15 of this Code.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
