ORDINANCE NO. 13,992

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by repealing Section 114-438 thereof and enacting a new Section 114-438, relating to windshields and windows on motor vehicles.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended by repealing Section 114-438 thereof and enacting a new Section 114-438, relating to windshields and windows on motor vehicles, as follows:

Sec. 114-438. Windshields and windows.

(a) No person shall drive a motor vehicle equipped with a windshield, sidewings, or side or rear windows which do not permit clear vision.

(b) No person shall operate on the highway a motor vehicle equipped with a front windshield, a side window to the immediate right or left of the driver, or a sidewing forward of and to the left or right of the driver which is excessively dark or reflective so that it is difficult for a person outside the motor vehicle to see into the motor vehicle through the windshield, window or sidewing. "Excessively dark or reflective" means that the windshield, front side windows or front sidewings do not meet the minimum measurable standard of transparency established by rules promulgated by the state department of transportation.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
