AN ORDINANCE vacating Alley between 15th and 16th Streets Woodland Avenue and High Street

WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and

WHEREAS, it is desirable that the public right-of-way herein described be vacated; NOW, THEREFORE,

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That Alley between 15th and 16th Streets Woodland Avenue and High Street, be and is hereby vacated: The sixteen foot (16') East/West alley right-of-way between Woodland Avenue and High Street, West of 15th Street, adjoining Lot 2, in Block 2, J.M. Griffith's Subdivision of Lot 5, Pursley Addition, and adjoining the East 1/2 of Lot 2 and Lots 3, 4 and 5 in Block E, Subdivision of Lot 6 of 13.06 Acres Pursley Estates, all now included in and forming a part of the City of Des Moines, Polk County, Iowa

Section 2. That this vacation is made with reservations of 1. Reservation of easements for any existing public utilities within the alley right-of-way. 2. Provision of a new public through access easement within the proposed parking lot to ensure proper traffic circulation and fire protection access for the subject property and surrounding property. 3. Limiting the access onto 15th to one driveway for the site with a private access easement for the property adjoining to the south.

Section 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa.

Section 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
