ORDINANCE NO. 14,099
AN ORDINANCE vacating alley right-of-way located between 1st and 2nd Streets north of Vine Street.
WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and
WHEREAS, it is desirable that the public right-of-way herein described be vacated; NOW, THEREFORE,
BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:
Section 1. That the remaining alley right-of-way, if any, located within the following described parcel, be and is hereby vacated:
A parcel of land in Block 35, Fort Des Moines, an Official Plat all now included in and forming a part of the City of Des Moines, Polk County, Iowa, being more particularly described as follows: Commencing at the northwesterly corner of Lot 3 of said Block 35; thence South 15° 30' 00'' East along the westerly line of said Block 35, a distance of 8.73 feet, to the Point of Beginning; thence northeasterly 14.04 feet along a 20.00 foot radius curve concave southeasterly having a long chord of 13.75 feet bearing North 53° 56' 09'' East; thence North 74° 02' 41'' East, a distance of 147.10 feet; thence South 15° 30' 00'' East, a distance of 265.48 feet; thence South 72°55' 30'' West a distance of 152.09 feet; thence northwesterly 14.80 feet along a 12.50 foot radius curve concave northeasterly having a long chord of 13.95 feet bearing North 50 °09' 11'' West, to a point of the westerly line of said Block 35; thence North 15° 30' 00'' West, along the westerly line of said Block 35, a distance of 252.18 feet, to the Point of Beginning, containing 42,672 square feet more or less.
Sec. 2. That the City Clerk is hereby authorized and directed to cause a certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa.
Sec. 3. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
