AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by repealing Sections 2-1059 and 22-46 thereof and enacting new Sections 2-1059 and 22-46, relating to the reappointment of members to the Des Moines International Airport Board.
Be It Ordained by the City Council of the City of Des Moines, Iowa:
Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended by repealing Sections 2-1059 and 22-46 thereof and enacting new Sections 2-1059 and 22-46, relating to the reappointment of members to the Des Moines International Airport Board, as follows:
Sec. 2-1059. Term limits.
(a) Except as otherwise specifically provided, no person shall be approved or confirmed by the city council to serve a third or subsequent consecutive term on any city board, committee, commission or agency. However, an appointment to serve an unexpired term or a special initial term used to achieve staggered terms on a board, committee, commission or agency shall not be considered in applying this limitation if the unexpired term or special initial term is less than one-half the duration of a normal term on such board, committee, commission or agency. Further, terms commencing prior to June 30, 1994, shall not be considered in applying this limitation.
(b) No person serving on any city board, committee, commission or agency shall be approved or confirmed by the city council to serve on a second city board, committee, commission or agency to serve overlapping terms except to fill a position on the second board, committee, commission or agency which is required by this Code or the resolution establishing the second board, committee, commission or agency, to be filled by a member of the first board, committee, commission or agency. This shall not prevent a person holding two such offices from being reappointed to a second consecutive term on the first board, committee, commission or agency.
Sec. 22-46. Established; composition; appointments.
(a) There is established in and for the city the Des Moines International Airport Board, referred to in this article as the "board," created under I.C. ch. 392, for the purpose of governing the operation of the airport pursuant to the terms of this article and this Code.
(b) The board shall consist of seven members, each having the right to vote, with each councilperson appointing one member of the board. The term of each member shall be for four years. Any member may be removed by a majority vote of the city council for good cause shown as determined by the city council. The terms of board members shall expire on and as of June 30 of the year in which their terms expire. Notwithstanding section 2-1059 regarding term limits, members of the board may be reappointed for a third or subsequent consecutive term.
Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
