AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by repealing Sections 14-117 and 102-1123 thereof and enacting new Sections 14-117 and 102-1123, relating to permits required under Chapter 14, Amusements and Entertainments and street use permits required under Chapter 102, Streets, Sidewalks, Skywalks and Other Public Places.
Be It Ordained by the City Council of the City of Des Moines, Iowa:
Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended by repealing Section 14-117 and 102-1123 thereof and enacting new Sections 14-117 and 102-1123, relating to permits required under Chapter 14, Amusements and Entertainments and street use permits required under Chapter 102, Streets, Sidewalks, Skywalks and Other Public Places, as follows:
Sec. 14-117. Permit required.
(a) No timed event or athletic event shall be permitted on the streets, sidewalks, alleys, or public places without the sponsor or organizer first obtaining a timed event and athletic event permit from the city, except for timed events or athletic events that will take place entirely upon a city park and has been approved by the park and recreation director or his or her designee.
(b) Every applicant for such permit shall apply in writing to the city clerk. Such application shall be submitted at least 30 days prior to the proposed date.
(c) The permit application shall contain the following information:
(1) The name and address of the applicant and that of the sponsor.
(2) If the application is made on behalf of an organization, the name and address of the organization.
(3) The names and phone numbers of two contact persons.
(4) The proposed date of the event.
(5) A description of the location where the event will assemble.
(6) The time of commencement.
(7) The proposed route and maximum length of the event submitted on a map.
(8) The number of participants anticipated.
(9) The time the event will conclude and the participants will disperse.
Sec. 102-1123. Permit required.
A street use permit is required for the temporary closure of any portion of a street for any event, activity, block party, festival, or events of similar character and nature, except where the temporary closure is in connection with an event or activity to take place on city park property and is approved by the park and recreation director or his or her designee.
Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
