ORDINANCE NO. 14,114

AN ORDINANCE to amend the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, by rezoning and changing the district classification of certain property located in the vicinity of the 500 block of North Valley Drive from the "FW" Floodway District to the "U-1" Floodplain District classification.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, be and the same is hereby amended by rezoning and changing the district classification of certain property located in the vicinity of the 500 block of North Valley Drive, more fully described as follows, from the "FW" Floodway District to the "U-1" Floodplain District classification:

Commencing at a point being 100.0 feet West of the East line of the Southeast ¼ (Quarter) of Section 11, Township 78 North, Range 25 West of the 5th P.M. and being 1240.0 feet North of the South line of said Section 11, also being the Point of Beginning; thence northwesterly along a straight line to the centerline of North Valley Drive right-of-way, as now established, being the intersection of a line measured 499.0 feet East of the East line of Miksich Place, an Official Plat; thence northeasterly along said centerline of North Valley Drive right-of-way, as now established, to a point being the intersection of a line measured 650.0 feet East of the East Lot lines of said Miksich Place; thence southeasterly along a straight line to a point being 850.0 feet East of the East line of said Miksich Place and being 1890.0 feet North of the South line of said Section 11; thence southeasterly along a straight line to a point being 140.0 feet West of the East line of said Section 11 and being 1645.0 feet North of the South line of said Section 11; thence southeasterly along a straight line to a point being 100.0 feet West of the East line of said Section 11 and being 1595.0 feet North of the South line of said Section 11; thence South along a straight line to the Point of Beginning, all now included in and forming a part of the City of Des Moines, Polk County, Iowa. Said tract of land contains 5.98 acres more or less.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.

Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof to be properly filed in the office of the Recorder of Polk County, Iowa.
