AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 13,855, passed August 21, 2002, by repealing Sections 114-636, 114-637 and 114-638 thereof and enacting new Sections 114-636, 114-637 and 114-638, and adding and enacting new Sections 114-640.01, 114-640.02 and 114-640.03 relating to parking meters and resident permit parking.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 13,855, passed August 21, 2000, is hereby amended by repealing Sections 114-636, 114-637 and 114-638 thereof and enacting new Sections 114-636, 114-637 and 114-638, and adding and enacting new Sections 114-640.01, 114-640.02 and 114-640.03 relating to parking meters and resident permit parking, as follows:

Sec. 114-636. Parking meter and resident permit parking district no. I.

Parking meter district no. I shall be constituted of all the streets and avenues located within the area bounded by the west side of the Des Moines River, north of Grand Avenue, thence south to Riverside Drive, thence south, on the west side of Riverside Drive, to the south side of Elm Street, thence west to the west side of 8th Street, thence north to the south side of Vine Street, thence west to west side of 9th Street, thence north to the south side of Cherry Street, thence west to the west side of 10th Street, thence north to the south side of Mulberry Street, thence west to the west side of Eleventh Street, thence north to the north side of Walnut Street, thence east to the west side of Tenth Street, thence north to the north side of Pleasant Street, thence east to the west side of 8th Street, thence north to the north side of Watson Powell, Jr. Way, thence east to the east side of 2nd Avenue, thence south to the north side of Grand Avenue, thence east to the point of beginning, except parking meter districts no. II and III, as described in sections 114-637 and 114-638 of this division.

 

Sec. 114-637. Parking meter and resident permit parking district no. II.

Parking meter district no. II shall be constituted of all the streets and avenues located within the area bounded by the west side of Tenth Street, north of Pleasant, thence south to the north side of Walnut Street, thence west to the west side of Eleventh Street, thence south to the south side of Mulbery Street, thence east to the west side of Tenth Street, thence south to the south side of Cherry Street west of 10th Street, thence west to the west side of 13th Street, thence north to the south side of Mulberry Street, thence west to the west side of 16th Street, thence north to the south side of Locust Street, thence west to the west side of Fleur Drive, thence northwest to the south side of Grand Avenue, west of 19th Street, thence north to the north side of Woodland Avenue, thence east to the west side of 12th Street, thence north to a point even with the north side of Chestnut Street, thence east to the west side of 9th Street, thence north to the north side of Keosauqua Way, thence northwest to the west side of 10th Street, thence north to the north side of School Street, thence east to the east side of West Riverside Drive, thence south to the north side of Watson Powell, Jr. Way, thence west to the east side of 8th Place, thence south to the north side of Pleasant Street, thence west to the west side of 10th Street, thence south to the point of beginning, except parking meter districts no. I and III as described in sections 114-636 and 114-638 of this division.

Sec. 114-638. Parking meter and resident permit parking district no. III.

Parking meter district no. III shall be constituted of all the streets and avenues located within the area bounded by the west side of the Des Moines River, south of Court Avenue; thence north to the north side of Grand Avenue; thence east to the west side of East First Street; thence north 190.13 feet, to East River Drive; thence north 500 feet; thence east to a point east of East Fifth Street, on the north side of Lyon Street; thence east to the west side of East Twelfth Street; thence south to the south side of Des Moines Street; thence west to the east side of Pennsylvania Avenue, north of Locust Street; thence south to the south side of Locust Street at East Seventh Street; thence south to the south side of Vine Street; thence west to the west side of East First Street; thence north to the south side of Court Avenue; thence west to the point of beginning, except parking meter districts no. I and II as described in sections 114-636 and 114-637 of this division.

 

Sec. 114-640.01. Resident parking permits.

The city traffic engineer is authorized to issue an annual resident parking permit, at a fee of $25.00 per month, for residents living within the parking meter and resident parking permit districts, as defined by Sec. 114-636, 114-637 and 114-638. Resident parking permits will be issued on an annual basis only. The fee of $25.00 per month will be prorated on a monthly basis from the start of the effective period of the resident parking permit for permits issued after the start of the effective period for the most current resident parking permit. Resident parking permits will be of one color and design, as determined by the city traffic engineer, and this color and design will change on an annual basis for enforcement purposes, as determined by the city traffic engineer.

 

Sec. 114-640.02. Resident parking permit placement.

Residents issued residential parking permits are required to apply and display the resident parking permit on the front passenger side windshield of the vehicle. The resident parking permit will be of such a design that it must be applied to the inside of the windshield of the vehicle in a permanent manner consistent with the type of parking permit issued.

 

Sec. 114-640.03. Residency requirements for issuance of a resident parking permit.

Residents must be able to establish to the satisfaction of the city traffic engineer that their permanent residence is within the boundaries of parking meter and resident permit parking districts I, II or III to be eligible for issuance of a resident parking permit. Proof of residence will normally be a copy of a signed and executed lease document.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
