AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, as heretofore amended, by repealing the definition of 'vision clearance triangle' in Section 134-3, and enacting a new definition of 'vision clearance triangle' in Section 134-3, to clarify the location of the required vision clearance triangle at the intersection of private driveways and public streets.

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, as amended by Ordinance No. 13,832 passed June 19, 2000, as amended by Ordinance No. 13,839 passed July 10, 2000, as amended by Ordinance No. 13,889 passed November 20, 2000, be and is hereby amended by repealing the definition of 'vision clearance triangle' in Section 134-3, and enacting a new definition of 'vision clearance triangle' in Section 134-3, to clarify the location of the required vision clearance triangle at the intersection of private driveways and public streets, as follows:

Sec. 134-3. Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Vision clearance triangle means, at street intersections, a triangular area as required by section 114-14 of this Code; at the intersection of any driveway and a public right-of-way, a triangular area above a height of two feet above grade level formed by the intersection of the edge of the driveway with the right-of-way line, and a line joining points on the edge of the driveway and the right-of-way line 15 feet from the point of intersection. The vision clearance triangle may extend upon an abutting property. However, in no case shall there be any interference with required sight distance as determined by the department of engineering.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
