ORDINANCE NO. 14,170

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, as heretofore amended, by repealing Section 82-2 thereof, and enacting a new Section 82-2, to place all fees for applications to the Zoning Board of Adjustment into a Schedule of Fees to be adopted by the City Council by resolution.

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, be and is hereby amended by repealing Section 82-2 and subsection (e) of Section 134-248 thereof, and enacting a new subsection (e) of Section 134-248, and by adding and enacting a new Section 134-248, to place all fees for applications to the Zoning Board of Adjustment into a Schedule of Fees to be adopted by the City Council by resolution, as follows:

The required fee for an application for a variance, exception, special permit, conditional use or other relief from the board of adjustment shall be in the amount set in the Schedule of Fees adopted by the city council by resolution. In addition to such fee the applicant shall pay the estimated notification costs for the hearing as determined by the community development department.

Sec. 2. This ordinance shall be in full force and effect from and after the later of January 1, 2003, or its passage and publication as provided by law.
