AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, as heretofore amended, by adding and enacting a new Article X , titled "Planning Review Fees", to Chapter 82, to provide for the recovery of the administrative costs of reviewing applications for low income housing tax credits.

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, be and is hereby amended by adding and enacting a new Article X , titled "Planning review fees", to Chapter 82, to provide for the recovery of the administrative costs of reviewing applications for low income housing tax credits, as follows:

The purpose of this article is to provide for the recovery of the administrative costs of reviewing specified types of projects for conformance with the city's land use plan, comprehensive housing plan, strategic development plan and other adopted city facility and development plans and objectives.

A fee is hereby imposed upon the following activities in the amounts set in the Schedule of Fees adopted by the city council by resolution:

(a) Request for city approval or support of an application to the Iowa Finance Authority for low income housing tax credits.

Sec. 2. This ordinance shall be in full force and effect from and after the later of January 1, 2003, or its passage and publication as provided by law.
