AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by amending Section 78-69 of Article III, Transient Merchants and Section 78-107 of Article IV, Solicitation of Funds of Chapter 78, Peddlers and Solicitors, to set forth miscellaneous fees in a schedule of fees adopted by the city council by resolution.
Be It Ordained by the City Council of the City of Des Moines, Iowa:
Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended by amending Section 78-69 of Article III, Transient Merchants and Section 78-107 of Article IV, Solicitation of Funds of Chapter 78, Peddlers and Solicitors, to set forth miscellaneous fees in a schedule of fees adopted by the city council by resolution, as follows:
Sec. 78-69. License fee.
(a) The applicant for a transient merchant license shall pay a fee at the time of filing the application in the amount set in the Schedule of Fees adopted by City Council by resolution.
(b) In the event the application for a transient merchant license is denied or withdrawn by the applicant, either all or a portion of the license fee in an amount set in the Schedule of Fees adopted by the City Council shall be retained by the city to defray the administrative costs incurred.
Sec. 78-107. License fee.
(a) The applicant for a license to solicit funds shall pay a license fee to the city clerk at the time of filing the application in the amount set in the Schedule of Fees adopted by City Council by resolution. There shall be no prorated fees.
(b) In the event that the application is filed less than 30 calendar days prior to the start date of soliciting, an additional late fee shall be paid in an amount set in the Schedule of Fees adopted by City Council by resolution.
(c) In the event the application is withdrawn by the applicant or is denied either initially or on appeal, either all or a portion of such license fee in an amount set in the Schedule of Fees adopted by the City Council by resolution shall be retained by the city to defer the administrative costs incurred.
Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
