AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 13,887, passed November 20, 2000, and Ordinance No. 13,916, passed February 12, 2001, and Ordinance No. 13,929, passed March 12, 2001, and Ordinance No. 14,011, passed November 5, 2001, and Ordinance No. 14,063, passed March 18, 2002, and Ordinance No. 14,086, passed May 6, 2002, by amending Section 74-177, Botanical Center space rental and admission fees, Section 74-181, golf course fees, 74-182, lodge, park shelter and other park rental fees, 74-183, aquatic centers, swimming pools and marina fees, 74-185, Simon Estes Riverfront amphitheater fees, and 74-185.1, fees for the showmotion stage, and adding and enacting new Sections 74-174, regarding recreation cards, Section 74-175, regarding portable picnic table rentals and Section 74-187 regarding temporary fees adjustment that may be changed at the discretion of the park and recreation director.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 13,887, passed November 20, 2000, and Ordinance No. 13,916, passed February 12, 2001, and Ordinance No. 13,929, passed March 12, 2001, and Ordinance 14,011, passed November 5, 2001, and Ordinance No. 14,063, passed March 18, 2002, and Ordinance No. 14,086, passed May 6, 2002, is hereby amended by amending Section 74-177, Botanical Center space rental and admission fees, Section 74-181, golf course fees, 74-182, lodge, park shelter and other park rental fees, 74-183, aquatic centers, swimming pools and marina fees, 74-185, Simon Estes Riverfront amphitheater fees, and 74-185.1, fees for the showmotion stage, and adding and enacting new Sections 74-174, regarding recreation cards and Section 74-175, regarding portable picnic table rentals, and Section 74-187 regarding temporary fees adjustment that may be changed at the discretion of the park and recreation director, as follows:

 

Sec. 74-174. Recreation card.

Effective on April 8, 2003, residents with a recreation card issued by the park and recreation department or other valid forms of identification indicating residence shall be eligible for resident fee rates. Recreation cards shall be issued for a period of five years. Children under the age of six (6) years who are residents do not need a recreation card to receive resident fee rates if they are accompanied by a person holding a recreation card. Recreation card fees are $3.00 per person. Replacement recreation cards are $3.00 per person.

 

Sec. 74-175. Portable Picnic Table Rentals.

Fees for portable picnic tables rentals are as follows:

(b) Additional fees for use of the Botanical Center shall be as follow:

(2) Overtime:

a. Prior to 7:00 a.m., per hour - $25.00

b. Evening after 11:00 p.m., per hour - $25.00

c. Oak Room and Willow Room during normal operating hours, per hour - $20.00

d. Classroom, evening, per hour - $15.00

 

(3) Special balcony rental, Friday evenings or extended hour schedule (6:00 to 11:00 p.m.) - $100.00

(c) Admission fees to the Botanical Center (Monday through Saturday, Sundays shall be free) shall be as follows:

(1) Adults (18--64) - $ 2.00

(2) Children (six years and under 16 years) - $1.00

(3) Children (under six years) - No charge

(4) Senior citizens (65 years and over) - $1.00

(5) Adult tours (group size of 10 or more) - 25% Off

(6) Senior tours (group size of 19 or more) - $25% Off

(7) Season pass - $10.00

(8) Promotional adult discount rate - $0.75

(9) Promotional senior citizens group rate - $0.50

(10) Child/student group rate - $0.25

(11) Promotional child/student discount - $0.25

 

Effective on April 8, 2003, admission fees to the Botanical Center (Monday through Sunday) shall be as follows:

Sec. 74-181. Golf courses.

 

(a) Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

Weekdays are Monday through Thursday.

Weekends are Friday, Saturday and Sunday.

(b) Greens fees. The golf course greens fees listed in subsections (b)(1) and (2) of this section are total costs which include irrigation, reservation, and tax. Greens fees for golf courses shall be as follows:

Sec. 74-182. Lodge, park shelter and other park rentals.

 

Fees for lodges, park shelter and other park rentals shall be as follows:

(1) Waveland Lodge. Available October 1 through Christmas for non-golf functions and evenings on a limited basis January 1 through March 31, per hour - $40.00

(2) Sylvan Theater (electricity $15.00 extra), per day - $20.00

(3) Garden reservation fee. For one-hour session, must specify garden area:

a. Clare and Miles Mills Rose Garden:

1. Residents $25.00

2. Non-residents $35.00

b. Union Formal Garden $10.00

(4) Shelter houses. Unless otherwise specified, shelter houses are reserved by session from 10:00 a.m. to 3:00 p.m.; or 4:00 p.m. to 9:00 p.m.

a. Enclosed Shelters (Grandview North, Greenwood, Pioneer, MacRae and Union):

1. Weekdays - $30.00

2. Weekends/holidays - $35.00

3. Nonresident additional fee - $10.00

(8) Wading pool rental. Available during playground season only, per hour (minimum three hours) - $20.00

 

Sec. 74-183. Aquatic centers, swimming pools and marina.

Fees for use of city aquatic centers, swimming pools and the marina shall be as follows:

(1) Northwest, Nahas, Teachout, Birdland Aquatic Centers and Ashworth Pool admissions:

a. Youth (three through seven years) - $1.00

b. Students (eight to 15 years) - $3.00

c. Adults (16 years and over) - $5.00

(2) Good Pool admissions:

a. Youth (three through seven years) - $0.75

b. Students (eight to 15 years) - $1.00

c. Adults (16 years and over) - $1.25

(5) Pool rental. All rentals are usually after hours, exceptions may be made. The park and recreation director has the option to waive the fee:

Plus, per person after 50 persons - $1.00

b. Corporate rental, per hour - $300.00

Plus, per person after 100 persons - $1.00

c. Seasonal agency rental, per person per week - $2.00

Plus, per person per season for nonresidents - $10.00

d. Swim meet rentals, per day - $80.00

(6) Birdland Marina moorage fees. All moorage fees include tax. All rentals are based on availability:

a. Seasonal:

1. Double access, long length - $430.00

2. Double access, regular length - $400.00

3. Single access, regular length - $375.00

b. Monthly, single access only - $150.00

c. Weekend rate, in after 12:00 noon on Friday, out by 6:00 p.m. Sunday - $30.00

 

Sec. 74-185. Simon Estes Riverfront Amphitheater fees.

 

  1. Concert admission. Fees for attendance at concerts sponsored or presented by the city shall be as follows:

Under 12 years of age: Free

12 years and older $8.00

Season pass $56.00(b) Electricity. Fees for use of electricity at the amphitheater, per session, shall be as follows:

(1) Basic public address system . . . . No charge

(2) Additional electrical hookup for plaza area . . $ 50.00

(3) Additional electrical panel for stage area . . . . 150.00

 

(c) Rental fees. Rental fees for the use of the amphitheater shall be as follows:

(1) Free Public Event.

a. Per four-hour session\ $500.00

Plus, for each additional hour\$100.00

(2) Fee Based Event.

a. Per four-hour session\$750.00

Plus, for each additional hour\175.00

b. Fourteen percent (14%) of gross revenue from vending.

(3) Weddings/Private Parties.

Sec. 74-185.1. Showmotion Stage.

Fees for the use of the showmotion stage shall be provided in this section as follows:

(a) Rental Fee

Park Event $300.00

Public Event Co-sponsored $300.00

(b) Staff Charges (apply to all rentals)

4-hour minimum $160.00

Addition hours after 4-hour

minimum $ 40.00/hour

(c) Miscellaneous Fees

Basic Sound System Rental $ 100.00/day

Additional Stage Section $ 15.00/section/day

Generator rental $ 25.00/day

Sec. 74-187. Temporary fee adjustment.

Fees as determined in sections 74-176 through 74-186, and section 34-69 of this article may be changed at the discretion of the park and recreation director upon the approval of the city manager for engaging in special projects, programs or promotions that justify such change, including reduced fees to provide access to park and recreation programs and facilities to low income residents.

 

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
