ORDINANCE NO. 14,211

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, as heretofore amended, by repealing Sections 82-247 and 82-248 thereof, and enacting new Sections 82-247 and 82-248, and by adding and enacting a new subsection (12) to Section 82-249 regarding the appointment of members to the Neighborhood Revitalization Board.

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, as amended by Ordinance No. 13,909 passed January 22, 2001, be and is hereby amended by repealing Sections 82-247 and 82-248 thereof, and enacting new Sections 82-247 and 82-248, and by adding and enacting a new subsection (12) to Section 82-249 regarding the appointment of members to the Neighborhood Revitalization Board, as follows:

Sec. 82-247. Qualifications and nominations.

(a) All nominations to the neighborhood revitalization board are subject to confirmation by the city council.

(b) Five members of the board shall be residents of the city who either have a household income of not greater than 80 percent of the city median income or reside within census tracts where at least 51 percent of the residents are low or moderate income persons, who shall represent the interests of low and moderate income city residents.

(c) Five members of the board shall be residents of a recognized neighborhood, who shall represent the interests of the residential neighborhoods of the city.

(d) Three members of the board shall be an owner or officer of a business or nonprofit agency or an officer or employee of an educational institution located within the city, who shall represent the interests of the city's business, nonprofit and educational community. Notwithstanding section 2-1049 of this Code, the members nominated to represent the interests of the city's business nonprofit and educational community need not be residents of the city.

(e) The Neighborhood Finance Corporation shall nominate one member to the board who is a member of the Neighborhood Finance Corporation board.

(f) The Greater Des Moines Partnership shall nominate one member to the board who is a member of the Des Moines Development Corporation board.

(g) The Neighborhood Development Corporation shall nominate one member to the board who is a member of the Neighborhood Development Corporation board.

Sec. 82-248. Terms of office.

(a) The appointments to the neighborhood revitalization board of the five members representing the interests of low income residents of the city shall be for staggered terms of three years.

(b) The appointments to the board of the five members representing the interests of the residential neighborhoods of the city shall be for staggered terms of three years.

(c) The appointments to the board of the three members representing the interests of the city's business, nonprofit and educational community shall be for staggered terms of three years.

(d) The appointments of the representatives of the Neighborhood Finance Corporation, Greater Des Moines Partnership and Neighborhood Development Corporation shall be for one-year terms expiring June 30 of each year.

Sec. 82-249. Responsibilities and duties.

The neighborhood revitalization board shall have the following responsibilities and duties:

(12) The board shall endeavor to provide the city council with a list of at least three qualified candidates willing to accept appointment to the board whenever a vacancy occurs in any at position other than the positions required to be held by representatives of the Neighborhood Finance Corporation, Greater Des Moines Partnership and Neighborhood Development Corporation.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
