AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 13,924, passed February 26, 2001, and Ordinance No. 14,084, passed May 6, 2002, and Ordinance No. 14,161, passed November 18, 2002 and Ordinance 14,195, passed December 18, 2002, by amending Sections 22-307 to Chapter 22, Aviation and Sections 114-236, 114-305.03, 114-354.01, 114-357, 114-358, 114,360, 114-361, 114-361.01 through 114-361.03, 114-361.05 through 114-361.17, 114-361.19, 114-362, 114-366.05, 114-485.02, 114-485.09, 114-600 through 114-613, 114-613.01, 114-614, 114-616, 114-620, 114-621, 114-623 through 114-627, 114-630, 114-632, 114-645, 114-646, 114-668, 114-1104 and 114-1105 to Chapter 114, Traffic and Vehicles, and adding and enacting a new Section 22-311 to Chapter 22 and Section 114-15 to Chapter 114, relating to motor vehicle operation at the airport and parking fines.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 13,924, passed February 26, 2001, and Ordinance No. 14,084, passed May 6, 2002, and Ordinance No. 14,161, passed November 18, 2002 and Ordinance 14,195, passed December 18, 2002, is hereby amended by amending Sections 22-307 to Chapter 22, Aviation and Sections 114-236, 114-305.03, 114-354.01, 114-357, 114-358, 114,360, 114-361, 114-361.01 through 114-361.03, 114-361.05 through 114-361.17, 114-361.19, 114-362, 114-366.05, 114-485.02, 114-485.09, 114-600 through 114-613, 114-613.01, 114-614, 114-616, 114-620, 114-621, 114-623 through 114-627, 114-630, 114-632, 114-645, 114-646, 114-668, 114-1104 and 114-1105 to Chapter 114, Traffic and Vehicles, and adding and enacting a new Section 22-311 to Chapter 22 and Section 114-15 to Chapter 114, relating to motor vehicle operation at the airport and parking fines, as follows:

(a) No person shall operate a motor vehicle or other motorized equipment of any kind on the airport in a reckless or negligent manner or without caution or in a manner which endangers or is likely to endanger persons or property.

(b) No person shall operate a motor vehicle or other motorized equipment of any kind on the airport in excess of the 20 mile per hour speed limit, unless otherwise posted.

(c) No person shall operate a motor vehicle or other motorized equipment of any kind on the airport in excess of the posted speed limit.

(d) No person shall fail to give pedestrians and aircraft the right-of-way over vehicular traffic. All ground vehicles shall pass to the rear of taxiing aircraft, unless otherwise directed by air traffic control personnel.

(e) No person operating a motor vehicle on the airport shall fail to give proper signals or fail to observe the directions of posted traffic signs or traffic lanes.

(f) No person under the influence of liquor or drugs shall operate a motor vehicle on the airport.

(g) No vehicle shall be operated on an open ramp, taxiway, or runway except by persons assigned to duty thereon or by persons authorized by the aviation director.

(h) No person shall clean or make any repairs to motor vehicles anywhere on the airport other than in designated shop areas, except those minor repairs necessary to remove such motor vehicle from the airport; nor shall any person move, interfere, or tamper with any motor vehicle or put in operation the engine or take or use any motor vehicle part, instrument, or tool thereof without permission of the owner or satisfactory evidence of the right to do so duly presented to the aviation director.

(i) No vehicle shall be driven or parked on the air carrier ramp in apron areas between an aircraft and its loading gate or under a passenger loading bridge.

(j) When parking adjacent to a runway, all vehicles must park outside of the runway safety area, unless such runway is officially closed by the aviation director or approved maintenance requirements dictate otherwise.

(k) The aviation director shall have the authority to tow or otherwise move a motor vehicle that is parked by its owner or operator on the airport in violation of the regulations of the airport, at the operator's expense and without liability for damage which may result in the course of or because of such moving.

(l) In all cases, the provisions of chapter 114 of this Code govern as to the operation of motor vehicles on all roads on the airport unless otherwise specified in this chapter.

 

(a) No person shall park a motor vehicle, for loading, unloading, or any other purpose, on the airport other than in the areas specifically established for parking and in the manner prescribed by signs, lines or other means. No person shall park a motor vehicle at any point on Cowles Drive or at any point on an airport service road. No person shall abandon any motor vehicle on the airport. No person shall park a motor vehicle in an area requiring payment for parking thereon without paying the required parking fee or in a manner so as to obstruct roadways or in aircraft parking areas or on grass areas. No person shall park a motor vehicle in a runway protection zone.

(b) Parking violations at the airport may be charged on a simple notice of fine as provided in sections 114-485.04 through 114-485.09. A person who violates any provision of this section shall pay a fine of $20.00. Unpaid parking tickets may be charged as a misdemeanor or municipal infraction as provided in section 22-12 herein.

(c) Whenever a rental vehicle is involved in a parking violation committed by a customer or employee of the rental company, the company shall be chargeable with the violation and shall be required to pay any parking fine resulting from such violation if not paid by the violator.

 

Whenever a rental vehicle is involved in a parking violation described in this chapter committed by a customer or employee of the rental company, the company shall be chargeable with the violation and shall be required to pay any parking fine resulting from such violation if not paid by the violator.

(a) As used in this section, the term "snow tires" means tires designed for use when there are conditions of snow or ice on the highways and meeting the requirements which shall be promulgated by rule of the director of the state department of transportation pursuant to I.C. § 321.236(12).

(b) When conditions of snow or ice exist on the traffic surface of a designated snow route, it is unlawful for the driver of a vehicle to impede or block traffic if the driving wheels of the vehicle are not equipped with snow tires, tire chains or nonslip differential.

(c) Any person charged with impeding or blocking traffic for lack of snow tires, chains or nonslip differential shall have the charge dismissed upon a showing to the court that his or her motor vehicle was equipped with a nonslip differential.

(d) Standing or parking of vehicles upon a street designated as a "snow route" shall be prohibited at any time when snow-removal operations are in progress and before such operations have resulted in the removal or clearance of snow from such streets. (e) A person who violates the provisions of subsection (d) of this section shall pay a fine of $35.00.

 

(a) Unless prohibited by this Code or other city ordinances regulating or restricting the parking or standing of vehicles on the streets as designated in division 5 of article XVI of this chapter, vehicles may be stopped or parked on such one-way streets with the lefthand wheels adjacent to and within 18 inches but not closer than two inches of the lefthand curb of such streets. Any motorcycle may be stopped or parked with its rear wheel within 18 inches of the lefthand curb.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) The operator of a bus shall not stop such vehicle upon any street at any place for the purpose of loading or unloading passengers or their baggage other than at a bus stop, bus stand or passenger loading zone, except in an emergency.

(b) The operator of a bus shall enter a bus stop, bus stand or passenger loading zone on a public street in such a manner that the bus, when stopped to load or unload passengers or baggage, shall be in a position with the right front wheel of the vehicle not further than 18 inches from the curb and the bus approximately parallel to the curb so as not to impede unduly the movement of other vehicular traffic.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park or permit a vehicle to stand on any viaduct within the city.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) No person shall stop, stand or park a vehicle, except when necessary to avoid a conflict with other traffic or in compliance with the directions of a police officer or traffic control device, in any of the following places:

(1) On a sidewalk.

(2) In front of or within two feet of a public or private driveway.

(3) Within an intersection.

(4) On a crosswalk.

(5) Within ten feet upon the approach to any flashing beacon, stop sign or traffic control signal located at the side of a roadway.

(6) Between a safety zone and the adjacent curb or within ten feet of points on the curb immediately opposite the ends of a safety zone.

(7) Within 50 feet of the nearest rail of a railroad crossing, except when parked parallel with such rail and not exhibiting a red light.

(8)Alongside or opposite any street excavation or obstruction when such stopping, standing or parking would obstruct traffic.

(9)On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

(10)Adjacent to or on the center parkway or dividing area of any divided street.

(11)In front of a curb cut or ramp which is located on public or private property in a manner which blocks access to the curb cut or ramp.

A person who violates any provision of subsection (a) shall pay a $15.00 fine.

(b) No person shall stop, stand or park a vehicle, except when necessary to avoid a conflict with other traffic or in compliance with the directions of a police officer or traffic control device, in any of the following places:

(1) Within five feet of a fire hydrant.

(2) Within 20 feet or the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of the entrance when property signposted.

(3) Where any official traffic control device prohibits stopping or parking.

A person who violates any provision of subsection (b) shall pay a $30.00 fine.

(c) No person shall stop, stand or park a vehicle, except when necessary to avoid a conflict with other traffic or in compliance with the directions of a police officer or traffic control device, upon any street when the stopping, standing or parking is prohibited by the sections of this chapter relating to removal of snow or ice from the streets. A person who violates the provisions of this subsection shall pay a $35.00 fine.

(a) A space of 25 feet is reserved at the side of the street in front of every theater, auditorium, hotel having more than 25 sleeping rooms, office building having more than three stories or other building where large assemblages of people are being held. No motor vehicle shall be left standing, parked or stopped within these spaces except in taking on or discharging passengers or freight or picking up tickets, and then only for a length of time necessary for such purposes, provided that such spaces shall first be marked by signs with the words "no parking - loading zone" or "no parking - ticket pick-up" thereon, as appropriate, or the curbing adjacent thereto painted with yellow paint.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) Except as otherwise provided in this chapter and including as specifically provided in section 114-305.03 of this chapter as to one-way streets, every vehicle stopped or parked upon a roadway where there is an adjacent curb shall be stopped or parked with the righthand wheels of the vehicle parallel with and within 18 inches but not closer than two inches of the righthand curb.

(b) It shall be unlawful to drive any vehicle against or upon any curb damaging any part thereof.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) The initiation of angle parking at any location where such parking is not in existence is prohibited except at the following locations:

(1) Bridal Row, on the east side, from Fifteenth Street to Pleasant Street.

(2) Court Avenue, on the south side, from First Street to Fifth Avenue.

(3) Keosauqua Way, on both sides, from Sixth Avenue to Seventh Street.

(4) East First Street, on the east side, from Locust Street to Grand Avenue.

(5) Market Street, on the north side, from Southwest Third Street to Southwest Fourth Street.

(b) Angle parking shall be permitted to continue at locations where the distance between the painted centerline and the parking curbline is equal to or greater than the minimum requirement established by the following formula:

Minimum Width from Centerline

to Parking Curbline = VAVE/400 x 10' + 19'

(c) The letters "VAVE" as used in the formula in subsection (b) of this section represent the average hourly volume of cars during the four highest hours of a day.

(d) The cost of installing and maintaining facilities for angle parking shall be borne by the abutting property owners, and if they or any of them shall fail to refuse to do so, the city reserves the right to withdraw the privilege of this method of parking.

(e) Nothing within this section shall prohibit parking by more than one motorcycle within one parking space as otherwise provided in this chapter.

(f) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) No person shall drive, stop, stand, or park a vehicle onto or upon privately owned property or an area developed as an off-street parking facility, without the consent of the owner, lessee or person in charge of the privately owned property or facility. A violation of this section shall place such vehicle in the status of an illegally parked vehicle and, upon complaint of the owner, lessee or person in charge of the privately owned property or facility, the vehicle may be dealt with pursuant to section 114-485.11 of this chapter.

(b) No person shall park a vehicle in violation of the front yard parking provisions in subsection 134-1377(m) of this Code.

(c) A person who violates any provisions of this section shall pay a fine of $40.00.

(a) The following described parking areas are reserved parking space for city employees and officials, designated by the city manager:

(1) The north 133.4 feet of block 3, East Fort Des Moines, lying south of and adjoining East Grand Avenue between East First Street and East Second Street.

(2) All of the entire paved parking lot lying between the west curbline of East First Street and the Des Moines River and between the north line of East Vine Street and the main line track of the Des Moines Union Railway Company.

(3) All of the entire paved parking lot lying between the south line of the Municipal Court Building and such line projected east, and a line ten feet north of and parallel to the centerline of the main line track of the Des Moines Union Railway Company and extending from the east line of East First Street to the west line of East Second Street.

(4) All of the entire paved parking lot lying between the south line of the police department garage and such line projected west and the south line of the Municipal Court Building projected east and extending from the east line of the Municipal Court Building to the west line of East Second Street.

(5) All of the entire paved right-of-way under the Eighth Street Viaduct from Cherry Street to a point 180 feet north thereof.

(6) The south 20 feet of vacated East Vine Street from the east right-of-way line of East First Street to the west right-of-way line of East Second Street, and the north 22 feet of lot 5, all of lots 6 and 7 and the vacated north/south alley of and adjoining lot 7, all in block C, Scott and Dean's Addition.

(b) Only the designated city employees and officials shall park in the reserved and restricted areas. Every such employee and official must display an authorized city parking permit on the vehicle.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall drive, stop or park a vehicle onto or upon property controlled by the Des Moines Independent Community School District between the hours of 6:00 a.m. to 12:00 midnight, Monday through Friday, except those persons who have obtained permission from the school district and clearly display a permit to park on such property. A violation of this section shall place such vehicle in the status of an illegally parked vehicle and, upon complaint of the school district, the vehicle may be dealt with pursuant to section 114-485.11 of this chapter.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) No person shall park a vehicle in the southeast section of the main library parking lot at First and Walnut without displaying an authorized city parking permit which is specifically designated by the library director. All parking spaces in this area are reserved for official library vehicles only.

(b) No person shall park a vehicle in the paved parking lot immediately south of the branch library at 3516 Fifth Avenue after business hours. This lot is reserved for library customers only during business hours.

(c) No person shall park a vehicle in the paved parking lot adjacent to the branch library at 5000 Franklin Avenue after business hours. This lot is reserved for library customers only during business hours.

(d) No person shall park a vehicle in the paved parking lots immediately adjacent to the mid-city branch library at 1305 University Avenue and directly south of the branch library on the south side of University after business hours. These lots are reserved for library customers only during business hours.

(e) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) The following described portion of the city-owned parking lot located north of and adjacent to the Armory Building at East First and Des Moines Streets is reserved as parking spaces for authorized American Legion employees and city employees and officials:

Lot 1 of block 1, East Fort Des Moines Addition, except the south 27 feet thereof; lot 1, through and including lot 12, Sibley Addition, except the south 27 feet of lot 12; the 14-foot wide alley between lot 9, Water Power Place Plat Two and Sibley Addition; part of lot 9, Water Power Place Plat Two beginning at the northeast corner of such lot 9 thence southerly 330 feet along the east lot line; thence westerly to the top of the riverbank; thence northerly along the top of the riverbank to the east abutment of the Center Street Dam; thence northerly along the east abutment to the north lot line; thence easterly along such north lot line to the point of beginning; also, the south half of lot 13, Griffiths Outlots and the alley between such lot 13 and lot 1, Sibley Addition.

No person except those designated persons shall park in the reserved and restricted area between the hours of 7:00 a.m. and 4:30 p.m. All designated persons must display an authorized city parking permit on their vehicle.

(b) No person shall park a motor truck at any time in the armory parking lot.

(c) The city engineer is directed to erect appropriate signs informing the general public of the restrictions.

(d) A person who parks a vehicle in violation of any provision of this section shall pay a fine of $15.00.

(a) No person shall park nor shall any owner knowingly permit to be parked upon any street, park road or publicly owned parking facility any motor vehicle required to be registered unless there shall be attached thereto and displayed thereon when and as required by law a valid registration plate issued therefor for the current registration year.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) No person shall park a vehicle in any alley except for the expeditious loading, unloading and delivery which is incident to the loading and unloading of material or merchandise or passengers. In no event shall any vehicle park in any alley for more than 40 minutes at any one time.

(b) A person who violates any provision of this section shall pay a fine of $30.00

(a) No person shall park a vehicle on any portion of any street between the curbline and the lot line, except that on recommendation of the city engineer, duly approved by resolution of the city council, parking may be permitted at such locations when requested in writing by property owners.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No vehicle shall be parked within a distance of 20 feet on either side of a United States post office-owned mail collection box which is so placed and equipped as to permit the deposit of mail from vehicles on the roadway.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park a motor vehicle under any bridge or viaduct within the city when signs giving notice of the regulation have been posted under the bridge or viaduct.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park any vehicle and permit it to remain standing upon any public street or public metered lot in the city continuously and in one place for a period of more than 24 hours.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall stand or park a vehicle upon any roadway for the principal purpose of:

(1) Advertising.

(2) Displaying it for sale.

(3) Washing, greasing or repairing it, except for repairs necessitated by an emergency.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall excavate or obstruct any street until he or she shall have first obtained a permit authorizing such excavation.

(b) The city engineer may authorize the erection of temporary no parking signs alongside or opposite the area of excavation if the stopping, standing or parking of vehicles therein would obstruct traffic.

(c) A person who parks a vehicle in violation of the no parking signs erected by authority of this section shall pay a fine of $15.00.

(a) When signs are erected giving notice thereof, no person shall park a motor vehicle on any cul-de-sac.

(b) When signs are erected giving notice thereof, no person shall park in the turnaround area nor at any place between the posted sign and the dead end of a dead-end street.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) The chief of police may, upon issuance of an emergency order, cause temporary no parking signs to be posted on or about streets of the city. No person shall park in violation of signs so posted.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) The city traffic engineer is authorized to issue a public service parking permit for a vehicle to park or stand on a public street where such parking or standing is otherwise prohibited or regulated by the provisions of this chapter. Application therefor may list one or more specific vehicles, shall be directed to the office of the city traffic engineer, and may contain such information, including vehicle characteristics and license, as the city traffic engineer shall deem pertinent to the application. Such permit shall only be issued when said parking or standing is required in the performance of a public service or to satisfy a public need as heretofore set forth. Such permit shall grant permission for:

(1) Vehicular parking or standing in a specific area which may be designated as "point or points of service"; or

(2) Vehicular parking or standing in any public way in the city which, by the nature of the service, becomes a point of service.

(b) The effective period of the permit may be a set number of days, not to exceed one year, and the inclusive dates of the permit shall be clearly displayed thereon. The permit may also specify the time or times of day when such parking is authorized as well as the days of the week to which it is limited.

(c) Except in situations of immediate emergency or in unique situations which have been identified to and approved by the city traffic engineer, such parking shall be prohibited on arterial and collector streets during the hours from 7:00 a.m. to 9:00 a.m. and from 4:00 p.m. to 6:00 p.m. where signs are currently in place prohibiting parking during these hours.

(d) The permit so issued for the specific vehicle or a clearly legible copy thereof shall be placed conspicuously in the window of the vehicle for which issued in a manner which clearly displays the restrictions contained in the permit.

(e) The phrases "point of service" and "point or points of service" shall not include parking of a vehicle while the owner or operator awaits call or service. Vehicles in such status or condition shall be subject to the remaining provisions of this chapter regulating the parking, standing, and stopping of vehicles.

(f) The city traffic engineer may either collect a fee of $25.00 per vehicle for a period of 30 days or less in advance or direct the applicant to consider the permit as an invoice with payment due immediately upon receipt by mail or facsimile. At such time as parking meter spaces are hooded or removed for special permit purposes the permittee shall also be responsible for a daily rate of the metered use. If parking meters are hooded specifically for a special event after 6:00 p.m. and until 8:00 a.m. the following day, or on meter holidays and weekends, the only charges shall be the $25.00 permit fee and $1.00 for each meter hooded. The charges for the fee and the hooding of parking meters for a non-recurring special event, after 6:00 p.m. and until 8:00 a.m. the following day, or on meter holidays and weekends, may be waived at the discretion of the city traffic engineer or his or her designated representative. The following rates shall apply during normal hours of parking meter operation:

(1) At all $0.30 per hour meters, the rate shall be $3.00 per day.

(2) At all $0.50 per hour meters, the rate shall be $4.00 per day.

(3) At all $1.00 per hour meters, the rate shall be $7.50 per day.

Vehicles owned or operated by governmental agencies, shall be exempt from the permit fee requirements. Vehicles and equipment working directly under contract to the City of Des Moines shall also be exempt from these permit fee requirements. Subcontractors are not exempt.

(g) A person who parks a vehicle in violation of any provision of this section or of the terms of the special parking permit shall pay a fine of $15.00.

(a) No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition and removing the key, or, when standing upon any perceptible grade, without effectively setting the brake thereon and turning the front wheels to the curb or side of the highway.

(b) A person who violates any provision of this section shall pay a fine of $10.00

(a) No person shall stop, park or leave standing any vehicle, whether attended or unattended, within any fenced portion of the right-of-way of the Des Moines Freeway, also known as Interstate Highway 235 and as the MacVicar Freeway, except duly authorized construction, maintenance and law enforcement vehicles and vehicles present for the purpose of servicing or removing a disabled vehicle or aiding the injured. This subsection shall not apply to the driver of any vehicle which is disabled in such manner and to such extent that it is impossible to avoid stopping and temporarily leaving a disabled vehicle in such position.

(b) The driver of a disabled vehicle shall, if possible, stop or push the vehicle off the paved or improved part of the main traveled part of the right-of-way. Whenever any peace officer finds a vehicle standing upon such right-of-way in violation of this section or disabled, such officer is authorized to remove the vehicle or to cause the driver or other person in charge of the vehicle to remove the vehicle.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) For the purposes of this article, a delinquent parking citation-complaint is one which has not been paid within 30 days of the date upon which the violation occurred.

(b) Any person who has allowed four or more overtime and/or illegal parking citation-complaints issued on a motor vehicle or registration plate to become delinquent shall be deemed to be a habitual violator.

(c) No person shall park a vehicle and permit it to remain standing upon any public street or public metered lot or city-owned parking facility when there are four or more delinquent parking citation-complaints outstanding against that vehicle.

(d) A violation of this section shall place such vehicle in the status of an illegally parked vehicle, and the vehicle may be dealt with pursuant to section 114-485.11 of this article.

(e) A person who violates any provision of this section shall pay a fine of $30.00.

 

(a) Failure to pay a parking citation-complaint within 30 days of its issuance or to timely contest such citation under this article shall render the charges contained herein admitted.

(b) Except for handicapping parking violations under section 114-616 of this chapter. The fine on all other parking violations in this chapter or chapter 22 of this code are increased by $5.00 if the parking violation is not paid within thirty days of the date upon which the violation occurred, unless the parking violation is timely contested pursuant to section 114-485.05 of this code. If the parking violation is timely contested then the provisions of section 114-485.05 of the code shall apply for purposes of the stopping and starting of the thirty day period.

(a) When signs are erected giving notice thereof, no person shall park a vehicle at any time at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $30.00.

(a) When signs are erected giving notice thereof, no person shall park a vehicle between the hours specified in this section on any day at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction:

(1) No parking 7:00 a.m. to 6:00 p.m.

(2) No parking 4:00 p.m. to 9:00 a.m.

(3) No parking 10:00 p.m. to 7:00 a.m.

(4) No parking 7:00 a.m. to 4:00 p.m.

(5) No parking 7:00 a.m. to 5:00 p.m.

(6) No parking 8:00 a.m. to 5:00 p.m.

1. No parking 4:00 p.m. to 9:00 a.m.

(8) No parking 10:00 p.m. to 6:00 a.m.

(b) A person who violates any provision of this section shall pay a fine of $30.00.

Sec. 114-602. Parking prohibited during certain hours on certain days.

(a) When signs are erected giving notice thereof, no person shall park a vehicle between the hours specified in this section on certain days at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction:

(1) No parking 7:00 a.m. to 5:00 p.m., school days.

(2) No parking 8:00 a.m. to 5:00 p.m., school days.

(3) No parking Monday through Friday.

(4) No parking Monday through Saturday.

(5) No parking 7:00 a.m. to 9:00 a.m., Monday through Friday.

(6) No parking 7:00 a.m. to 9:00 a.m., school days.

(7) No parking 7:00 a.m. to 6:00 p.m., Monday through Friday.

(8) No parking 7:00 a.m. to 5:00 p.m., Monday through Friday.

(9) No parking 7:00 a.m. to 6:00 p.m., Monday through Saturday.

(10) No parking 8:00 a.m. to 5:00 p.m., Monday through Saturday.

(11) No parking 8:00 a.m. to 3:00 p.m., school days.

(12) No parking 8:00 a.m. to 1:00 p.m., Sundays.

(13) No parking 4:00 p.m. to 6:00 p.m., Monday through Friday.

(14) No parking 1:00 p.m. Sunday through 1:00 a.m. the following Sunday.

(b) A person who violates any provision of this section shall pay a fine of $30.00.

 

(a) When signs are erected giving notice thereof, no person shall stop or stand a vehicle between the hours of 7:00 a.m. and 5:00 p.m. on any school day at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) When signs are erected giving notice thereof, no person shall stop or stand a vehicle at any time at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) When signs are erected giving notice thereof, no person shall stop or stand a vehicle except buses at any time at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) Within and at loading zones designated in division 9 of article XVI of this chapter as subject to such restriction, parking is prohibited, except that a vehicle involved in loading, unloading and delivery which is incident to loading and unloading may use such zones for those purposes, subject to the restriction that no vehicle shall park in any loading zone for the purpose of such loading, unloading and delivery at any time to exceed 20 minutes.

(b) A person who violates any provision of this section shall pay a fine of $30.00.

(a) When signs are erected giving notice thereof, no person shall park any vehicle other than a school bus for the purpose of loading and unloading passengers between the hours of 7:00 a.m. and 5:00 p.m. on school days, at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction for a time exceeding 20 minutes.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) When signs are erected giving notice thereof, no person shall park any vehicle for other than the purpose of loading or unloading school passengers at any time or at the times specified in this section at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction:

(1) School passenger loading and unloading, 7:00 a.m. to 5:00 p.m. school days.

(2) School passenger loading and unloading, 7:00 a.m. to 5:00 p.m. school days; no parking at all other times.

(3) School passenger loading and unloading, 7:00 a.m. to 5:00 p.m. school days, 20 minutes only; no parking at all other times.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) When signs are erected giving notice thereof, no person shall park any vehicle, other than a bus for the purpose of loading or unloading passengers at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction. Such bus shall not park for such purpose for a time exceeding 20 minutes.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) When signs are erected giving notice thereof, no person shall park any vehicle for other than the purpose of loading or unloading passengers at any time or at the times specified in this section at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction:

(1) Passenger loading and unloading, 7:00 a.m. to 6:00 p.m., Monday through Friday.

(2) Passenger loading and unloading, 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., Monday through Friday.

(3) Passenger loading and unloading, 7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m., 20 minutes only, Monday through Friday.

(4) Passenger loading and unloading, ten minutes only.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall stop, stand, or park a vehicle other than a taxicab in a taxicab stand designated in division 9 of article XVI of this chapter as subject to such restriction and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading passengers when stopping does not interfere with any taxicab waiting to enter or about to enter the zone.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) When official signs are erected no person except police department personnel shall park a vehicle in those spaces and at those locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) When official signs are erected, no person shall park a vehicle in a parking space designated as a space for physically handicapped persons unless the vehicle displays, in a manner visible from outside such vehicle, a special identification device issued by the state department of transportation and the vehicle is being used, either as operator or passenger, by the individual to whom the device has been issued or another individual who is confined to a wheelchair or is otherwise so physically handicapped as to have significant difficulty or insecurity in walking.

(b) Parking spaces for the physically handicapped shall be in locations which are as convenient as is feasible to the exits from or entrances to the garages, metered lots, and public employee lots of the municipal parking system.

(c) A person who violates any provision of this section shall pay a fine of $100.00.

 

(a) When official signs are erected no person except sheriffs shall park a vehicle in those spaces and at those locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) When official signs are erected it shall be unlawful for any person except assigned employees of the clerk of the district court to park a vehicle in those spaces and at those locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) When official signs are erected, no person except United States Marshals shall park a vehicle in those spaces and at those locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) When official signs are erected no person except Department of the Treasury officials shall park a vehicle in those spaces and at those locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) Subject to all other sections of this article and when signs are erected giving notice thereof, no person shall park a vehicle continuously in any one block for more than one hour between the hours of 9:00 a.m. and 4:00 p.m., except Sundays, New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day, at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) Subject to all other sections of this chapter and when signs are erected giving notice thereof, no person shall park a vehicle continuously in any one block for more than two hours at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

 

(a) Subject to all other sections of this chapter and when signs are erected giving notice thereof, no person shall park a vehicle continuously in any one block for more than two hours between the hours of 9:00 a.m. and 4:00 p.m., except Sundays, New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day, at any of the locations designated in division 9 of article XVI of this chapter as subject to such restriction.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park a motor truck having a freight capacity greater than one ton or any trailer, semitrailer, tractor, road tractor or truck tractor unit at any time upon any portion of a street abutting property zoned R-1, R-2, R-3, or R-4 occupancy, as defined in chapter 134 of this Code.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall cause or allow any vehicle registered in the name of or operated by such person to be parked beyond the period of legal parking time established for any location designated in division 10 of article XVI of this chapter as subject to such restriction, or to deposit in any parking meter any coin for the purpose of parking beyond the maximum legal parking time for the particular location as designated in such article.

(b) No person shall permit any vehicle to remain or be placed in any parking space adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park any vehicle across any line or marking or area designated as a parking meter space or in such position that the vehicle shall not be entirely within the area designated by lines; markings, traffic control signing or the placement of one or more parking meter posts adjacent to the parking space which indicates the limits of a designated parking space.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) Parking of vehicles is limited in the locations specifically designated in this division between the hours stated for each location.

(b) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park a vehicle or allow a parked vehicle to remain in any public park, cemetery, community center or city recreational facility, except during the park facility hours set for that property in section 74-101 of this Code, unless special permission shall have been given by the parks and recreation director for such vehicle to remain there.

(b) A violation of this section shall place such vehicle in the status of an illegally parked vehicle, and the vehicle may be dealt with pursuant to section 114-485.11 of this chapter.

(c) A person who violates any provision of this section shall pay a fine of $15.00.

(a) No person shall park a vehicle in any public park, cemetery, community center or city recreational facility in such a manner as to block access to any road, driveway or building.

(b) No person shall park a vehicle in any public park, cemetery, community center or city recreational facility except in the places designated by the parks and recreation director.

(c) No person shall park a vehicle in Grandview Park except:

(1) In the lot at the west end of the park from sunrise to sunset.

(2) In the lot near the tennis courts.

(d) Parking spaces shall be provided in the interior of Grandview Park for the handicapped.

(e) A violation of this section shall place such vehicle in the status of an illegally parked vehicle, and the vehicle may be dealt with pursuant to section 114-485.11 of this chapter.

(f) A person who violates any provision of this section shall pay a fine of $15.00.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
