ORDINANCE NO. 14,331

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by amending Section 22-51 thereof, relating to adoption of regulations by the Des Moines International Airport Board.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, is hereby amended by amending Section 22-51 relating to adoption of regulations by the Des Moines International Airport Board, as follows:

Sec. 22-51. Adoption of regulations.

(a) Regulations proposed for adoption by the board shall be in writing. In adopting a regulation, the board shall take the following actions:

(1) File the proposed regulation with the city clerk;

(2) Publish notice of intent to adopt the regulation and of the time and place of a public hearing thereon, including therein a description of the regulation and its proposed effective date, and stating that it is on file with the city clerk;

(3) Notify the city council of the proposed effective date of the regulation and provide a copy thereof to the city council for its review;

(4) Hold a public hearing on the proposed regulation; and

(5) Adopt the regulation by board resolution and cause the city clerk to publish it prior to its effective date as provided by I.C. § 362.3.

(b) Except in an emergency requiring prompt action by the board, the adoption of a regulation shall occur at a regular board meeting following the regular meeting at which the public hearing on the regulation is held. If upon its review of a proposed regulation the city council determines that such regulation is inconsistent with this chapter or is inconsistent with any applicable state or federal law or regulation or is otherwise objectionable, the city council may so declare by resolution, and the proposed regulation shall not be published and shall not take effect. Regulations adopted by the board shall be effective upon their publication.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
