ORDINANCE NO. 14,382

 

AN ORDINANCE vacating a segment of Monroe Street right-of-way in the vicinity of 1300 S.E. 1st Street. 

 

WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and

 

WHEREAS, it is desirable that the public right-of-way herein described be vacated;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

 

Section 1.  That a segment of Monroe Street right-of-way in the vicinity of 1300 S.E. 1st Street, more specifically described as follows, be and is hereby vacated. 

 

All that portion of the Monroe Street right-of-way lying North of Block 19, South Fort Des Moines, an Official Plat, all now included in and forming a part of the City of Des Moines, Polk County, Iowa, except the South 40.0 feet of vacated Monroe Street right-of-way lying North of and adjoining Lot 8 of said Block 19, and lying North of and adjoining the North/South alley lying West of and adjoining said Lot 8 vacated by Ordinance No. 6800, November 14, 1962, and except that portion lying East of the following line: 

Beginning at a point on the northerly line of Lot 8, of said Block 19, which is 28.5 feet westerly on the Northeast corner of said Lot 8; thence North 09º(degrees) 38’ (minutes) 15” (seconds) West 16.43 feet to a point being 32.0 feet westerly of the northerly projection of the easterly line of said Block 19; thence North 16º22’51” West, 11.65 feet to a point being 42.5 feet westerly of the northerly projection of the easterly line of said Block 19; thence North 20º17’43” West, 18.26 feet to a point which is 40.0 feet northerly of the North line of said Block 19; and 53.70 feet westerly of the northerly projection of the easterly line of said Block 19; thence North 22º49’56” West, 25.15 feet to a point; thence northerly perpendicular to the North right-of-way line of Monroe Street, 6.0 feet to the North right-of-way line of Monroe Street. 

 

Sec. 2.  The City of Des Moines hereby reserves an easement upon the property described above for the continued use and maintenance of any utilities now in place, with the right of entry for servicing same. 

 

Sec. 3.  That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa. 

 

Sec. 4.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
