ORDINANCE NO. 14,433

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 14,367, passed August 9, 2004 by amending paragraph (14) of Section 22-50(a) thereof, relating to powers and responsibilities of the Des Moines International Airport Board.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 14,367, passed August 9, 2004 is hereby amended by amending paragraph (14) of Section 22-50(a) relating to the powers and responsibilities of the Des Moines International Airport Board, as follows:

Sec. 22-50. Powers and responsibilities.

(a) The board, except as otherwise provided in this chapter, shall have the authority to govern the operation of the airport, including but not limited to the following powers and responsibilities:

(14) Acquire by voluntary sale or gift property interests as necessary to implement the airport noise and land use compatibility plan or other plan approved by the board. The board shall establish the fair market value on all property interests to be acquired by the airport, except that it may delegate to the aviation director the establishment of fair market value on property acquisitions of $10,000.00 or less in value. All such acquisitions shall be accepted and approved by the city council.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
