ORDINANCE NO. 14,451

AN ORDINANCE to amend the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, by rezoning and changing the district classification of those portions of the "M-2" Heavy Industrial District which are predominantly occupied by uses that do not require "M-2" District zoning, from the "M-2" Heavy Industrial District to the "M-1" Light Industrial District classification.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, be and the same is hereby amended by rezoning and changing the district classification of the land described below from the "M-2" Heavy Industrial District to the "M-1" Light Industrial District classification:

a) All of those parcels of land described in the attached Exhibit "1".

b) That portion of each of the parcels of land described in the attached Exhibit "2" which is currently zoned to the "M-2" Heavy Industrial District. The portion of each of the parcels of land described in Exhibit "2" which is not currently zoned to the "M-2" Heavy Industrial District shall not be rezoned by this Ordinance and shall retain its current zoning classification.

b) The intervening portion of any highways, streets, alleys and railroad rights-of-way between the parcels and portions thereof hereby rezoned.

c) The adjoining one-half extending to the centerline of any highways, streets, alleys and railroad rights-of-way adjoining the parcels and the portions thereof hereby rezoned.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.

Sec. 3. That the City Clerk is hereby authorized and directed to cause certified copies of the vicinity map, this ordinance and proof of publication of a summary of this ordinance to be properly filed in the office of the Polk County Recorder.
