ORDINANCE NO. 14,456

 

AN ORDINANCE to amend the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, by rezoning and changing the district classification of certain property located in the Riverpoint West area generally bounded on the north by SW Cherry Street from SW 9th to SW 13th, by Mulberry Street from SW 13th to SW 16th, and by Locust Street from SW 16th to Fleur Drive; on the west and south by the levy of the Raccoon River; and on the east by SW 9th Street from the "M-1" Light Industrial District, "M-2" Heavy Industrial District, and "U-1" Floodplain District to the "C-3B" Central Business Mixed Use District classification.

 

 

Be It Ordained by the City Council of the City of Des Moines, Iowa:

 

Section 1.  That the Official Zoning Map of the City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000, be and the same is hereby amended by rezoning and changing the district classification of the Riverpoint West area generally bounded on the north by SW Cherry Street from SW 9th to SW 13th, by Mulberry Street from SW 13th to SW 16th, and by Locust Street from SW 16th to Fleur Drive; on the west and south by the levy of the Raccoon River; and on the east by SW 9th Street, more fully described as follows, from the "M-1" Light Industrial District, "M-2" Heavy Industrial District, and "U-1" Floodplain District to the "C-3B" Central Business Mixed Use District classification:

Beginning at the intersection of the southerly right-of-way line of Cherry Street and the westerly right-of-way line of 9th Street; thence southerly along the westerly right-of-way line of 9th Street and Southwest 9th Street to its intersection with the northerly toe line of the flood protection levee located North of the Raccoon River; thence westerly and northerly along the northerly and easterly toe of the levee of the flood protection levee located North and East of the Raccoon River to its intersection with the easterly right-of-way line of Fleur Drive; thence northerly along the easterly right-of-way line of Fleur Drive to its intersection with the southerly right-of-way line of Locust Street; thence easterly along the southerly right-of-way line of Locust Street to its intersection with the westerly right-of-way line of 15th Street; thence southerly along the westerly right-of-way line of 15th Street to the westerly extension of the southerly right-of-way line of Vacated Mulberry Street; thence easterly along the westerly extension of the southerly right-of-way line of Vacated Mulberry Street and continuing easterly along said southerly right-of-way of Vacated Mulberry Street and Mulberry Street to its intersection with the westerly right-of-way line of 13th Street; thence southerly along the westerly right-of-way line of 13th Street to its intersection with the southerly right-of-way line of Cherry Street; thence easterly along the southerly right-of-way line of Cherry Street to the Point of Beginning, all now included in and forming a part of the City of Des Moines, Polk County, Iowa.

 

 

Sec. 2.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.

Sec. 3.  That the City Clerk is hereby authorized and directed to cause certified copies of the vicinity map, this ordinance and proof of publication of this ordinance to be properly filed in the office of the Polk County Recorder.
