AN ORDINANCE to amend the Official Zoning Map of the
City of Des Moines, Iowa, set forth in Section 134-277 of the Municipal Code of
the City of Des Moines, Iowa, 2000, by rezoning and changing the district
classification of certain property located in the vicinity of 200 and 122 SW
16th Street, to impose the "S-O" Study Overlay District regulations
for a period of 20 years to assure that appropriate consideration is given to
the remediation of subsurface environmental conditions in any future
redevelopment of the property.

It Ordained by the City Council of the City of Des Moines, Iowa:
Section 1.
That the Official Zoning Map of the City of Des Moines, Iowa, set forth
in Section 134-277 of the Municipal Code of the City of Des Moines, Iowa, 2000,
be and the same is hereby amended by rezoning and changing the district
classification of certain property located in the vicinity of 200 and 122 SW
16th Street, more fully described as follows, to impose the "S-O"
Study Overlay District regulations for a period of 20 years from the effective
date of this Ordinance:
Beginning at the intersection of the South
right-of-way line of Wabash Street and the East right-of-way line of Southwest
16th Street; thence West along the South right-of-way line of Wabash
Street to its intersection with the East line of Lot 1, Dico Plat 1, an
Official Plat; thence South along East line of said Lot 1, to its intersection
with the northerly toe of the levee of the flood protection levee located North
of the Raccoon River; thence westerly and northerly along the northerly and
easterly toe of the levee of the flood protection levee located North and East
of the Raccoon River to its intersection with the South line of an Acquisition
Plat for Roadway Easement recorded in Book 10054 Page 541-644; thence easterly
along said South line of an Acquisition Plat for Roadway Easement and the
easterly extension of said South line of an Acquisition Plat for Roadway
Easement to the East right-of-way line of Southwest 17th Street;
thence South along said East right-of-way line of Southwest 17th
Street to point on said East right-of-way line of Southwest 17th Street said point being 15.0 feet South of
the Northwest corner of Lot 12, Block 4, City Place, an Official Plat; thence
East from said point on the East right-of-way line of Southwest 17th
Street along a line 15.0 feet South of and parallel with the North line of said
Lot 12, to the intersection of said line and the West line of Lot 3, Block 4,
of said City Place; thence North along said West line of Lot 3, of said Block
4, to the North line of said Lot 3; thence East along the North line of said
Lot 3, and its easterly extension to the East right-of-way line of Southwest 16th
Street; thence South along said East right-of-way line of Southwest 16th Street to the Point of Beginning, all now
included in and forming a part of the City of Des Moines, Polk County,
Iowa
Sec. 2. This
ordinance shall be in full force and effect from and after its passage and
publication as provided by law.
Sec. 3. That
the City Clerk is hereby authorized and directed to cause certified copies of
the vicinity map, this ordinance and proof of publication of this ordinance to
be properly filed in the office of the Polk County Recorder.
