ORDINANCE NO. 14,700

 

AN ORDINANCE vacating an irregular shaped strip on the east edge of 8th Place between Center Street and Park Street.   

 

WHEREAS, all prior requirements of law pertaining to the vacation of public right-of-way have been fully observed; and

 

WHEREAS, it is desirable that the public right-of-way herein described be vacated;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

 

Section 1.  That ­­­­­­­­­­­­the irregular shaped strip on the east edge of 8th Place between Center Street and Park Street, more specifically described as follows, be and is hereby vacated. 

 

That part of 8th Place right-of-way being a part of Lots 15, 19, and 20, and part of the vacated alley, Keosauqua Way Plat 1, an Official Plat, all now included in and forming a part of the City of Des Moines, Polk County, Iowa and described as follows:

 

Commencing at the Northeast corner of Lot 1 in Block “P” of Grimmel’s Addition to the Town of Fort Des Moines, being an Official Plat; thence North 89º(Degrees) 18’(Minutes) 26”(Seconds) West along the North line of said Lot 1 and along the North line of Keosauqua Way Plat 1, a distance of 202.37 feet to the point of beginning; thence South 13º40’45” East along the East right-of-way line of said 8th Place, 277.03 feet; thence North 20º08’45” West, 287.14 feet to the South right-of-way line of Center Street extended; thence South 89º18’26” East along said South right-of-way line extended, 33.38 feet to the point of beginning and containing 0.10 acres (4,479 S.F.).

 

 

Sec. 2.  The City of Des Moines hereby reserves an easement upon the property described above for the continued use and maintenance of any utilities now in place, with the right of entry for servicing same. 

 

Sec. 3.  That the City Clerk is hereby authorized and directed to cause certified copies of this ordinance and proof of publication thereof together with proof of publication of the notice of the public hearing on this matter to be properly filed in the office of the Recorder of Polk County, Iowa. 

 

Sec. 4.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
