ORDINANCE NO. 14,711
AN
ORDINANCE vacating Grandview Avenue between East 13th Street and
East 14th Street; the East/West and North/South alley between
Grandview Avenue and Morton Avenue east of East 13th Street; a
segment of the East/West alley between Morton Avenue and East Sheridan Avenue
from East 14th Street to a point approximately 84 feet to the west;
and all of the East/West alley between Grandview Avenue and Boyd Street from
East 13th Street to East 14th Street.
WHEREAS, all prior
requirements of law pertaining to the vacation of public right-of-way have been
fully observed; and
WHEREAS,
it is desirable that the public right-of-way herein described be vacated;
NOW, THEREFORE, BE IT
ORDAINED by the City Council of the City of Des Moines, Iowa:
Section 1. That Grandview Avenue between East 13th
Street and East 14th Street; the East/West and North/South alley
between Grandview Avenue and Morton Avenue east of East 13th Street;
a segment of the East/West alley between Morton Avenue and East Sheridan Avenue
from East 14th Street to a point approximately 84 feet to the west;
and all of the East/West alley between Grandview Avenue and Boyd Street from
East 13th Street to East 14th Street, more specifically
described as follows, be and is hereby vacated.
Parcel 1
All of the Grandview
Avenue right-of-way lying South of and adjoining Lots 16 through 29, and all of
the Grandview Avenue right-of-way lying South of and adjoining the West 31.50
feet of Lot 30, Block 6, Grand View, an Official Plat, all now included in and
forming a part of the City of Des Moines, Polk County, Iowa.

All of the East/West
alley right-of-way lying South of and adjoining Lots 7 through 15, and all of
the East/West alley right-of-way lying South of and adjoining the West 20.00
feet of Lot 6, Block 7, Grand View, an Official Plat, and the East 20.00 feet
of the West 45.00 feet of Lot 25, said Block 7, and a triangular parcel
described as follows: Beginning at the
Northwest corner of said Lot 25; thence easterly along the North line of said
Lot 25 a distance of 25.00 feet to a point; thence southerly along a straight
line parallel with the West line of said Lot 25, a distance of 25.00 feet to a
point; thence northwesterly along a straight line to the point of beginning, all
now included in and forming a part of the City of Des Moines, Polk County,
Iowa.

All of the East/West alley right-of-way lying South of and adjoining Lot 2, and all of the
East/West alley right-of-way lying South of and adjoining the West 34.50 feet of Lot 1, Block 12, Grand View, an Official Plat, all now included in and forming a part of the City of Des Moines, Polk County, Iowa.

East/West alley right-of-way lying South of and adjoining Lots 2 through 15,
and all of the East/West alley right-of-way lying South of and adjoining the
West 34.50 feet of Lot 1, Block 6, Grand View, an Official Plat, all now
included in and forming a part of the City of Des Moines, Polk County, Iowa.
Sec. 2. The City of Des Moines hereby reserves an
easement upon the property described above for the continued use and
maintenance of any utilities now in place, with the right of entry for
servicing same.
Sec. 3. That the City Clerk is hereby authorized and
directed to cause certified copies of this ordinance and proof of publication
thereof together with proof of publication of the notice of the public hearing
on this matter to be properly filed in the office of the Recorder of Polk
County, Iowa.
Sec. 4. This ordinance shall be in full force and
effect from and after its passage and publication as provided by law.
