ORDINANCE NO. 14,891        

 

 

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 14,244 passed June 23, 2003 by amending Sections 114-236, 114-236.01 and 114-236.02 and adding and enacting Section 114-236.015 and Division 11, Snow Priority Streets, Section 114-4175, relating to vehicle and parking restrictions, locations, street designations and the erection of signs for snow priority streets.  

 

Be It Ordained by the City Council of the City of Des Moines, Iowa:

    

     Section 1.  That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance No. 14,244 passed June 23, 2003 is hereby amended by amending Sections 114-236, 114-236.01 and 114-236.02 and adding and enacting Section 114-236.015 and Division 11, Snow Priority Streets, Section 114-4175, relating to vehicle and parking restrictions, locations, street designations and the erection of signs for snow priority streets, as follows: 

Sec. 114-236. Vehicle and parking restrictions in snow conditions.

 

(a)  As used in this section, the term "snow tires" means tires designed for use when there are conditions of snow or ice on the highways and meeting the requirements which shall be promulgated by rule of the director of the state department of transportation pursuant to I.C. § 321.236(12).

(b)  When conditions of snow or ice exist on the traffic surface of a designated snow route, it is unlawful for the driver of a vehicle to impede or block traffic if the driving wheels of the vehicle are not equipped with snow tires, tire chains or nonslip differential.

(c)  Any person charged with impeding or blocking traffic for lack of snow tires, chains or nonslip differential shall have the charge dismissed upon a showing to the court that his or her motor vehicle was equipped with a nonslip differential.

(d)  Standing or parking of vehicles upon a street designated as a "snow route" shall be prohibited at any time when snow-removal operations are in progress and before such operations have resulted in the removal or clearance of snow from such streets.

(e)  Standing or parking of vehicles upon a street designated as a “snow priority street” shall be prohibited at any time after 6:00 p.m. when snow-removal operations are in progress and before such operations have resulted in the removal or clearance of snow from such city streets.  

(f)  A person who violates the provisions of subsections (d) or (e) of this section shall pay a fine of $35.00. 

 

Sec. 114-236.01.  Snow route locations designated. 

 

     On the streets of portions of streets designated in division 4 of article XVI of this chapter, it shall be unlawful, when official signs have been erected giving notice of the designation of such streets as a snow route, to operate a motor vehicle contrary to section 114-236(d). 

 

Sec. 114-236.015.  Snow priority streets designated. 

 

     On the streets or portions of streets designated in division 11 of article XVI of this chapter, it shall be unlawful, when official signs have been erected giving notice of the designation of such streets as a snow priority street, to operate a motor vehicle contrary to section 114-236(e). 

 

Sec. 114-236.02. Erection of signs.

 

     The city engineer shall place and maintain signs indicating a snow route  or snow priority street at the entrances to the highway or part thereof affected and along its length, except where parking is prohibited at all times. These signs shall conform to the specifications set forth in the manual on uniform traffic control devices adopted by the state department of transportation.

 

ARTICLE XVI

 

Division 11.  Snow Priority Street

 

Sec. 114-4175. Designated.

 

     As provided in and in accordance with section 114-236.015 of this chapter, the following portions of streets are designated as snow priority streets and drivers of vehicles shall conform to the provisions of section 114-236.015 of this chapter:

 

(a) thru (v).  Not used.

(w)  Waterbury Residential Neighborhood.

1.   Forty-eighth Street from Ingersoll Avenue to Harwood Drive. 

     2.   Forty-ninth Stree4t from Harwood Drive to Waterbury Road. 

     3.   Fiftieth Street from Woodland Avenue to Pleasant Street

     4.   Fifty-first Street from Harwood Drive to Pleasant Street.

     5.   Fifty-second Street from Woodland Avenue to Pleasant Street. 

6.   Fifty-third Street from Shriver Avenue to Ingersoll Avenue. 

7.   Fifty-third Street from Waterbury Road to Ingersoll Avenue. 

     8.   Fifty-third Street from Woodland Avenue to dead-end north of Harwood Drive. 

     9.   Fifty-fourth Street from Harwood Drive to dead-end north.

     10.  Fifty-fourth Street from Waterbury Road to Ingersoll Avenue. 

     11.  Fifty-fifth Street from Harwood Drive to dead-end north.

     12.  Fifty-seventh Street from North Waterbury Road to Woodland Road. 

     13.  Fifty-seventh Street from Waterbury road to Ingersoll Avenue. 

     14.  Fifty-eighth Street from Walnut Hill Avenue to Waterbury Road. 

     15.  Fifty-ninth Street from North Waterbury Road to Harwood Drive. 

     16.  Sixtieth Street from Grand Avenue to Walnut Hill Drive. 

     17.  Sixty-first Street from Grand Avenue to Walnut Hill Drive. 

     18.  Sixty-first Street from Pleasant Drive to Woodland Road.

     19.  Sixty-second Place from Pleasant Drive to Rollins Avenue.

     20.  Sixty-second Street from Grand Avenue to Walnut Hill Drive. 

     21.  Sixty-second Street from Woodland Road to Pleasant Drive.

     22.  County Club Boulevard from Grand Avenue to Ingersoll Avenue. 

     23. County Club Boulevard from Ingersoll Avenue to Forty-ninth Street. 

     24.  Cummins Parkway from Ronwood Drive to Pleasant Drive. 

     25.  Cummins Parkway from Pleasant Drive to I-235. 

     26.  Harwood Drive from Fifty-sixth Street to Cummins Parkway.

     27.  Harwood Drive from Sixty-first Street to Sixty-second Street. 

     28.  Harwood Drive from Polk Boulevard to Woodland Avenue. 

     29.  North Waterbury Road from Fifty-sixth Street to Waterbury Circle. 

     30.  Pleasant Drive from Fifty-sixth Street to Sixty-third Street. 

     31.  Pleasant Street from Polk Boulevard to Fifty-second Street. 

     32.  Rollins Avenue from Sixty-second Place to Cummins Parkway. 

     33.  Ronwood Drive from Cummins Parkway Drive to dead-end south. 

     34. Shriver Avenue from Fifty-sixth Street to County Club Boulevard. 

     35.  Walnut Hill Avenue from Fifty-sixth Street to Fifty-ninth Street. 

     36.  Walnut Hill Drive from Fifty-ninth Street to Sixty-second Street. 

     37.  Waterbury Circle from North Waterbury Road to Fifty-sixth Street. 

     38.  Waterbury Road from Forty-eighth Street to County Club Boulevard. 

     39.  Waterbury Road from Fifty-sixth Street to County Club Boulevard. 

     40.  Waterbury Road from Fifty-ninth Street to Ingersoll Avenue. 

     41.  Waterbury Road from Fifty-ninth Street to Waterbury Circle. 

(x) thru (z).  Not used.

 

Sec. 2.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
