AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and amended by Ordinance 14,093 passed June 3, 2002, and Ordinance No. 14,177 passed December 16, 2002, and Ordinance No. 14,213 passed March 10, 2003, and Ordinance 14,567 passed June 5, 2006, and Ordinance 14,693 passed August 20, 2007, by adding a new paragraph (g) to Sections 46-1 and amending Section 46-62, relating to permits required for open fires or open burns and deletions of sections in the international fire code.

Be It Ordained by the City Council of the City of Des Moines, Iowa:

Section 1. That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, and Ordinance No. 14,177 passed December 16, 2002, and Ordinance No. 14,213 passed March 10, 2003, and Ordinance 14,567 passed June 5, 2006, and Ordinance 14,693 passed August 20, 2007 is hereby amended by adding a new paragraph (g) to Sections 46-1 and amending Section 46-62, relating to permits required for open fires or open burns and deletions of sections in the international fire code, as follows:

Sec. 46-1. Permits required.

(g) A permit shall be required for open fires or open burns pursuant to section 46-61. Outdoor fireplaces or grills burning untreated wood or charcoal used solely for the non-commercial preparation of food shall not be required to obtain a permit,

(h) The permit fees required by this section shall be doubled whenever a permit is not obtained prior to conducting the activities described in this section. No additional permits shall be issued to any person who owes the city the double fee established in this subsection.

Sec. 46-62. Deletions.

The following sections are hereby deleted from the international fire code adopted in section 46-61 of this article and are of no force or effect in this chapter:

(1) Sections 307.4, 307.4.1, 307.4.2, and 1106.5.4.

(2) Appendix A.

Sec. 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
